Dear Sir :
The following petition was heard at a meeting of the Planning
Board on Monday evening , June 1 , 1981 in the Town Office Meeting
Room at 7 : 30 p . m. The following members were present and voting :
Paul A. Hedstrom , Chairman ; Michael P. Roberts , Vice Chairman ;
and Erich W . Nitzsche .
A motion was made by Mr . Roberts and seconded by Mr . Nitzsche
to approve the Modification to a Definitive Plan entitled
Gilman Lane , located in North Andover , Mass . , dated April 21,
1981 , with the following conditions , with a completion date
of November 15 , 1981 .
Conditions of Approval - Gilman Lane :
1 . That , as required by the North Andover Board of Health in its
report to this Board , no building or other structure shall be
built on placed upon Lots as shown
on said plan without the prior consent o said--Board of Health .
2 . The plan shall be re-submitted to show the relocated drainage
easement on Lot 27 .
3. As per the Highway Surveyor , all work done within the street
shall be up to the existing subdivision standards .
4 . As per the Highway Surveyor , when the drainage leaves the
street in the low area , it will revert to a 15 " pipe to be
diagnally across from the road to meet the 18" pipe that goes
to Raleigh Tavern Lane.
5 . That the drainage easements be put in a recordable form and
the description be modified in accordance with the revised plan .

6 . To note that the Planning Board is aware that Mr . Cone has
submitted at

to the town of North Andover for no consideration .
7 . An easement deeded for drainage for Lot 23 shall be submitted .
8. That all work on said modification shall be completed no later
than November 15 , 1981 .

The undersigned hereby applies for the approval of said DEFINITIVE plan
by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public Works Department, the Highway Surveyor, the
Board of Health, and all general as well as zoning by-laws of said Town,
as are applicable to the installation of utilities within the limits of
rays and streets;
2. To complete and construct the streets or ways and other improvements shown
thereon in accordance with Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan, profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and made
a part of this application. This application and the covenants and agree-
ments herein shall be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said land, and assigns of the
undersigned; and
3. To complete the aforesaid installations and construction within two (2)
years from the date hereof.
