Dear Mr . Long ;
The Board of Appeals held a public hearing on Monday evening ,
November 14 , 1983 upon the application of David and Marie Law .
The hearing was advertised in the North Andover Citizen on
October 27 and November 3 , 1983 and all abutters were notified
by regular mail . The following members were present and voting :
Frank Serio , Jr . , Chairman ; Richard J . Trepanier , Esq . , Clerk ;
William J . Sullivan ; and Associate Members Walter F . Soule and
Raymond A. Vivenzio .
The petitioner seeks a variance from the provisions of Section 1 ,
Paragraph 7. 3 and Table 2 of the Zoning By Law so as to permit
relief from the side setback requirement to allow the continued
existence of a dwelling which does not meet the side setback
requirement on premises located at 82 Mifflin Drive .
The petitioners testified through counsel that the dwelling was
constructed in 1959 and when a plot plan was recently required
by the bank for mortgage purposes , the violation was discovered.
Upon a motion made by Mr . Vivenzio .and seconded by Mr. Trepanier,
the Board voted unanimously to grant the variance as requested .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . Specifically , the Board finds that the location of
the dwelling on the lot for several years with its _slight devia-
tion from the existing requirements constitutes a hardship to
the petitioner . Said variance may be granted without nullifying
or substantially derogating from the intent and purpose of the
Zoning By Law.
