Description of relief sought on this petition-to add=two (2) additional residential units to the existing structure for a total of four (4) units allowing some exterior structural change and an unenclosed stairway to second floor. 8. Deed- recorded in the Registry of Deeds in Book 2100, Page 110. Principal Points upon which application is based: Petitioner wishes to restructure an oversized building from a presently existing side by side duplex structure to a 4-unit (2 lower and 2 upper) apartment structure. The petitioner believes that the location is an appropriate location for such a use as it is at the zoning boundary district and abuts on all sides but one, cawercial and retail zoning dis- tricts. The proposed use will enhance the value of the property by upgrading both the interior and exterior of the building and thus improving the neighborhood. Petitioner asserts that he has provided through their offstreet parking plan, a safe and adequate means of handling the additional vehicles and by providing the offstreet parking, it will alleviate any present and future vehicle and parking problems in the area. It is believed by the Petitioner that the structure, when completed, will utilize the building in an optimum fashion as was the general purpose for the conversion by-law being placed into the Town's zoning by-law. It is also felt that the building will act as a buffer between the residenti zones and the rapidly growing commercial and business use which is encroaching on the re idential character of the neighborhood. The Petitioner islfurther requesting as necessary, determination as to whether the proposed exterior changes amount to a major exterior s ctural change under the by-law. if the Board so det ines that such is the case, th Petitioner is requesting that a variance be granted to allow for the limited exterior stru ural changes proposed. The Petitioner is asking fora variance of the zoning requirement t any stairway leading to a second or higher floor be enclosed, as the Petitioner believ the stairways to the second floor to the rear of the building would be safer and more thetically pleasing if left open and connecting to an open deck on the roof of the buildi g. Willis CFarles Foster , Building Inspector REGE ''E0 June 3, 1986 DAME .rPi0 TOW4 v _ERK WORcU ANDOVER Mr. Frank Serio, Chairman Jim 4 1 27M '86 North Andover Board of Appeals 120 Main Street North Andover, MA 01845 Dear Frank: As per our conversation last night, I am respectfully requesting reconsideration at your June 10 meeting of my application for a special permit to increase the number of units at 17-19 First _ Street, North Andover, Massachusetts to 4 residential units. These units would consist of two one-bedroom units located on the first floor and two two-bedroom units located on the second floor and attic space. As I mentioned in our discussion, my intent is to make smaller units in the structure to hopefully avoid having groups of individuals move into what is now considered half-house units. By reducing the size of the units, there will be a considerable reduction in the number of tenants per unit and consequently, the activity and parking needs for the building. I feel that it is important for me to show you the merits of this case and also to clear up any questions that your board may have in regards to this permit. My wife and I purchased this property in December of 1985 with the . intent of renovating the building and having my mother who is elderly live in one of the units. Because of its proximity to shopping facilities and the Town's Elderly Center, the building was ideally suited for her needs. As we took possesion of the house, it became apparent that its condition needed help, and quickly. Roofs leaked, plumbing was outdated and most importantly the electrical wiring was totally inadequate. we immediately began replacing items that were a safety hazard and rebuilt existing porches and replaced doors and windows. An architectural firm in Haverhill was engaged to show us how the building could be used more efficiently. on March 17, I brought these plans to Charlie Foster, the Building Inspector, to discuss and to obtain the necessary permit. Mr. Foster explained to me that I would need a special permit from your board to implement the additional two units. I asked Charlie if I could take the existing two units and move them to the second floor and attic space and he agreed. Mr. Foster's office then issued the building permit to me. It was clear at that time that there was no implied consent on Charlie's part as to the additional two units and that I would need to request a special permit from your board. From Charlie's office, I immediately went to your board's office and got the necessary forms from Audrey Taylor to request the special permit at your May 13th meeting. In the meantime, I hired Robert Daigle, a General Contractor, to begin the work to move the existing units upstairs. The first day on the job, the electrical service proved to be inadequate and there was a small electrical fire at the main box to the house. Mr. Daigle called in his electrician who in turn called me and relayed the problem. Frank as I mentioned in our conversation, I am not a developer and frankly did not fully comprehend what the electrician was telling me about the service and what was needed. By the time that Iof to the building that afte n 9 r oon there was a service installed with multiple boxes -5 to be exact( one for each unit and one for common area.) In hindsight, this may have been a poor decision on my part, but I assure you that it in no way was it an attempt to force the issue on the other two apartments. We painstakingly only did work that needed to be done for the two upstairs units and that the building in general demanded i.e. new roof and pointing of chimneys. I would like to conclude with what I feel are the merits of this project. we have taken an existing building that at best was an eyesore and at worst a safety hazard, as I soon found out. My wife and I are restoring the outside of the building to look as planned by the C.A.R.D. study in 1982 by Howard and Associates. We intend to put a parking facility on the land at the rear of the building which will accommodate ten cars by its present design but as you know in our original proposal only six spots were provided. This will eliminate the need for any on-street parking. The aesthetics will be nice and we feel that the building will be a real asset to the downtown area. A problem that seems to be surfacing in our Town is affordable units of quality housing for our elderly. The situation with my mother brought the issue close to home for us. As we see places like Heritage Green turn into relatively high priced condominiums, we think that the Town of North Andover will have a severe problem on their hands as to providing for the housing needs of those requested to vacate these condominiums. The additional units on First Street will be ideal for individuals seeking downtown locations. My wife and I have spent considerable amounts of our own capital on this project and the bank will not lend any construction money until a special permit is issued. We are both extremely concerned about our financial position in this project. Frank, I hope that you and your board will view this project to see what we are attempting to accomplish.
