Bear Sir:
Upon application of Margaret L. Legault to the North Andover Board of Appeals
for a variance under Section 7.3 of the North Andover'Zoning By-T.aws so as to
permit an extension of the present dining area, a public hearing was held on
January 19, 1969. The hearing was held is the town hall facilities after
having been advertised in the Lawrence Eagle Tribune on the dated December 28,
1968 and January 4, 1969 and with all abutters duly notified by certified mail.
The members of the Board present and voting weres dames A. Deyo, Chairman;
Arthur Drwmiond, Secretary, Daniel T. O'Leary, Donald J. Scott and J. Philip
Arsenault, Esq.
The applicant was represented by Atty. Anthony J. Randazzo who pleaded the
petition by stating that the applicant needed to expand the facilities to
provide better and more adequate service. To accomplish the desired expansion
the most practical approach was to the northwest as indicated on the accompany"
Ing plot plan. The relocation of the State road, Route 125, had in effect given
a substantial distance between the road and the proposed addition. Worts were
being made to procure a portion of this land so as to Increase the lot size, how-
ever no assurances could be made that this could be effected. There was ample
parking available to accomodate sash increased patronage that could result frm
the expansion. Traffic would not be hazardous as there were and would continue
to be two entrances and/or exits. That denial of the requested variance would
cause financial hardship in not permitting full utilization of facilities and
the site.
There were several questions directed to the proximity of the proposed extension
to the lot lines and to the street. No specific objections were noted.

After due deliberation, discussion including a general view of the site of the
variance, on a notion by Mr. O'Leary, seconded by Mr. Drummond, was granted on
a manimous vote of four, since somber Scott was not present when the vote was
taken.
The principal reasons for granting this variance requested are as fellows=
1. Granting the variance would not deviate from the intent and purpose of the
Zoning By--Laws.
2. Denial of the variance would cause hardship, financial or otherwise, to
the applicant.
3. The proposed expansion is in keeping with land uses in the innediate area
and will not be detrimental to the adjacent properties.
