Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
May 21, 1984 upon the application of Alice Lennon. The hearing
was advertised in the North Andover Citizen on April 19 and 26 ,
1984 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr. ,
Chairman; Richard J. Trepanier, Esq. , Clerk; William J. Sullivan;
and Associate Members Maurice S. Foulds and Raymond A. Vivenzio,
Esq.
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraphs 7. 1, 7.2 , 7. 3 and Table 2 of the Zoning By Law so as
to permit relief from the area, frontage and setback requirements
to allow the construction of a single family dwelling on the
premises located on the North side of Autran Avenue known as
Lot #52 , Autran Avenue.
Mrs. Lennon testified that an identical variance was granted by
the Board in 1979 , allowing the construction of a single family
dwelling on the lot. However, since a building permit was never
issued, the variance lapsed. No changes have occured since the
original application.
One abutter spoke in opposition; to the petition.
Upon a motion made by Mr. Trepanier and seconded by Mr. Vivenzio,
the Board voted unanimously to grant the variance as requested,
with the condition that only a single family dwelling may be
constructed on the lot, as requested in the petition.

In granting the variance , the Board finds that Section 10 . 4 of
the Zoning By Law has been satisfied. Specifically, the Board
finds that a literal enforcement of the provisions of the By Law
would create a financial hardship to the petitioner in that the
lot would be useless without said variance.
The Board further finds that said variance will not derogate from
the intent and purpose of the Zoning By Law nor will it create a
detriment to the public good.
