Dear Sir:
A public hearing was held by the Board of Appeals on June 11 , 1979 upon application
of John Lennon who requested a variation of Sec. 7.1 , 7.2, 7.3 and Table 2 of the
Zoning By—Law so as to permit relief from area, sideline and frontage requirements
on the premises located at Autran Ave. and shown on a plan of land dated March 1979.
The following members were present and voting: Alfred E. Frizelle, Esq., Vice—
Chairman; R. Louis Dig scio, Clerk; James D. Noble, Jr.; Richard J. Trepanier, Esq.;.
and Assoc. Member, William J. Sullivan.
The hearing was advertised in the North Andover Citizen on May 24 & 31 , 1979 and all
abutters were duly notified by regular mail.
The petitioner testified. that the lot in question was purchased prior to the enactment
of this By—Law and conformed to the zoning requirements then in effect. The petitioner
further stated that if releif was not granted that they would endure a financial hard—
ship since they would be unable to use the premises (Lot 52, Autran Ave.).
The Board upon motion by ?tr. Sullivan, seconded by Mr. Noble voted unanimously to
GRANT the variances requested. In granting these variances, the Board has found that
the particular lot in question, because of its size, creates a hardship in that the
petitioner would be unable to use the land by having to conform to the present By—Law.
Further, the Board has found that this relief can be granted without substantial
detriment to the public ;ood and without nullifying or substantially derogating from
the intent and. purpose of this By—Law. Specifically, the general area where the
premises is located lots are of similar size and shape and dwellings have been
constructed in a similar manner.
