Lyons, To= Clerk Town Building North, Andover., Mass. Dear Sir: The following petition was heard at a meeting of the Board of Appeals on Maaaday evening, August 12, 1963 at the Town Office Building. Members present and voting were: Daniel T. 011earys Chairman; William Morton, Secretary; Henry P. bund, Arthur Druuunond and John J. Shields. T. THEODCRE FREIJE requested a variation of sec. 6.5. Para. 6.51 and a special Permit under See. 4.4, Para, I,44 of the Zoning ByL-Law so as to permit the approval of a site plan review and a special permit for the construction and operation of a gasoline service station with two car lubritorium on the promises located at the north side of Osgood Street (Rte. 125), across from Great Pared Roe.. This public hearing was advertised in the Eagle Tribune on July 29 and ,August 5, 1963. An abutters were duly notified of this hearing by certified mail. Atty. Joseph Bacigalupo represented the petitioner; Mr. Pierce represented the Atlantic Refining Company. Atty, Ralph E. Finck represented Mr. & Mrs. 1113iam Chepulis who were opposed. Mr. & Mrse Norman Hines were also recorded as opposed. Mr. Shields made a motion to take the petition under advisement. Mr. Lund seconded the motion and the vote was unanizoase At an Executive Board Meeting held on September 39, 1963, the Board met with the petitioner, Atty. Bacigalupo and Mr. Pierce in order to clarify certain aspects of the case and to present more complete plans. on October 14, 1963, the Board fwther discussed and then vot ed on the petition. Mr. Shields made the following motion, seconded by Mr. Lured and voted unanimously* The motion is that a Special Permit be GFAWED to use this property as a gasoline station in accordance with the plan of land submitted as drawn by Koller Associates, Professional Engineers, with the stipulations that: A. All Board of Health requirements be complied with. B. That the easterly section of the lot indicated ftlandscaped with low- growing evergreens" shall be maintained under reasonable normal conditions to a depth of 75 feet from the street front lot line and from the indicated fence easterly to the stone wall shown on said plan; on the westerly lot line from the rail fence to the lot line p maintaining the sane depth of approximately 75 feet. Dear Sir: The following petition was heard at a meeting of the Planning Board on Thursday evening, March 15, 1962 at the Town Building. The decision was made on March 17, 1962 at a special meeting. The members present and voting were: James M. Bannan, Chairman; Howard L. Gilman, George Farley and William Chepulis, Jr. Theodore I. Freije petitioned to amend the North Andover Zoning By-TAv and the Zoning Map of the Town by changing from an Industrial to a General Business District a parcel of land, containing approx. !+5,000 square feet, on Osgood Street, bounded by land of the City of Lawrence, Albert A. Stein— berg and William Chepulis, Atty. Joseph F. Bacigalupo represented the petitioner. There was no opposition to the petition. Two abutters were present. At the Planning Board meeting on March 17, 1962, the board voted on the petition. Mr. Gilman made a motion to UM the petition and. Mr. Farley seconded the motion. The four members voted unanimously to deny the zoning change. The Board denied the petition beeause a great deal of effort was put into owftg?-'this area as Industrial.
