The petition of Joseph Jacques, 263 Mass. Ave. , Borth .Andover for a
variance of the Zoning ByTLaw so as to permit the erection of a Club
on the Easterly side of Osgood Street at the Southwest side of Brad-
ford Street came on to be heard at a meeting of the .Board on August ll.
Members present and voting were: Daniel O'Leary, Chairman, Kenneth
'Terroux, oobert Burke, Donald Smith and Alfred Roeglin, Associate
Member,
The Board Ends that the premises consist of 56,300 square feet, more
or less, as shown on the plan of land for Joseph Jacques, August 1958,
R�;ph Brasseur Ch. The premises are bounded on the Southwest of the
Jtiew y', .gland Telephone and telegraph Company. On the Westerly side of
Osgood Street, State Highway, is the Western Electric premises. To the
South ofthe premises are located two dwellings, and a greenhouse. To
the Southeast of the premises on Bradford Road are located several
other dwellings. Several abutters appeared in opposition to the pet-
ition.
'The Petitioner advises and the Board finds that he intends to erect a
Olub on the premises, that he intends toprovide parkkin pfoprtowoogrows
of cars between the buildings and Osgood Street , tth
further to provide a way of ingress from Osgood Street, egress on
Bradford Street. There was no evidence by the Petitioner that a denial
of a perm-2.t to use the premises for a Club would result in hardship
financially or otherwise. There was no showing by the Petitioner that
the premises in question differed from any other premises in the same
Zoning area.
Upon motion duly made and seconded, it was unanimously voted that the
petition be denied. The reasons for the finding, the Board finds no
evidenceof hardship will result to thePetitioner in his not being able

to use the premises for a Club; that there is no evidence that the
premises cannot be used for industrial purposes or other purposes per-
mitted in an Industrial area; and that to vary the requirements of the
BY-Law so as to permit the proposed use would be derogating from the
Zoning By-Law.
The Board has taken note of the fact that the Petitioner has not
applied to the building Inspector for a building permit and there
was no denial by the building Inspeeto filed wit this board.
