Murphy for a variation of Sections 4.04 and 4.11 of the Zoning By-Law to permit the remodelling of an existing structure now housing two family units to accomodate four families on the west side of Elm Street approx. 100 feet from the corner of Water Street and known as 94-96 Elm Street, as advertised in the Eagle Tribune on July 26 and August 2, 1969, was considered at the session of the North Andover Board of Appeals at their meeting in the Town Building on Monday, August 11, 1969. All abutters were duly notified by certified mail. The Board members present and voting were Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Donald J. Scott, J. Philip Arsenault, Esq. and Donald J. Leonard. Atty. John J. Lynch represented the petitioners and it was explained that the building was erected previous to the adoption of the present Zoning By-Laws. This is an old area which contains several buildings used for multi-familjndwellings and no apparent changes would be made to the building's exterior. No opposition was noted and upon unanimous vote the Board took the application under advisement. After some discussion during which it was brought out that the area was zoned for General Business and that there is a definite need for lower income rental units such as these in town. Donald Scott's motion to GRANT was seconded by Daniel T. O'Leary and so voted unanimously with the provision that Building Inspector Charles 11. Foster be consulted about adequate exits. Reasons for granting were that the requested variance will not be in substantial derogation from the intent or purpose of the Zoning By-Law. The requested variance will not adversely affect the public good to any substantial extent and will not materially affect the general character of the neighborhood. Dear Sir: A public hearing was held by the Board of Appeals on May 10, 1971 upon application of Robert L. Shea who requested a variation of Sec. 6.31 & 7.23 of the Zoning By- Law so as to permit the division of a parcel of land into two lots, each having less than the required frontage and area; on the premises located between Elm and Church Streets; approx. 100 feet distant from the corner of Water Street and known as 94-96 Elm Street and 59-61 Church Street. The following members were present and voting: J. Philip Arsenault, Esq.9 Chairman; Dr. Eugene A. Beliveau, Clerk; Kenneth E. Picard, Arthur R. Drummond and Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle-Tribune on April 24 and May 11 1971 and all abutters were duly notified by regular mail. Robert Shea appeared on his own behalf and explained that are presently two houses on one lot and he would like to have the parcel made into two lots so that each dwelling will have its own lot. These homes were formerly owned by Davis & Furber Machine Company and when they disposed of their properties none of them were on separate lots. Other lots in the area have the same or less area. He lives on the Church Street property and would like to sell the Elm Street property which was converted into four apartments. No one else spoke and there was no opposition. The petition was taken under advisement and during this period was reviewed by the Board. The Board found that the buildings on the land have been there since before the inception of the Zoning By-Law; there are now two buildings on the present lot. This situation is unusual and does not conform to the conditions generally in the zoning district. The Board found that if the variance is not granted, one of the houses could not be conveyed separately from the other and that this could result in a substantial hardship to the owner. The intent of the By-Law would be served by granting the variance because there would be no physical change in the area resulting from the granting of the variance and no additional structures would be permitted. Mr. Serio made a motion to GRANT the variance; Mr. Drumond seconded the motion and the vote was unanimous. Very truly yourst BQARD OF APPEALS . Murphy for a variation of Sections 4.04 and 4,11 of the Zoning By-Law to permit the remodelling of an existing structure now housing two family units to accomodate four families on the west side of Elm Street apnrox. 100 feet from the corner of Water Street and sown as 94-96 Elm Street, as advertised in the Eagle Tribune on July 26 and August 2, 1969. was considered at the session of the North Andover Board of Appeals at their meeting in the Town Building on Monday, August 11, 1969. All abutters were duly notified by certified mail. The Board members present and voting were Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Donald J. Scott, J. Philip Arsenault, Esq. and Donald J. Leonard. Atty. John J. Lynch represented the petitioners and it was explained that the building was erected previous to the adoption of the present Zoning By-Laws. This is an old area which contains several buildings used for multi-ftniljrldwellings and no apparent changes would be made to the building's exterior. No opposition was noted and upon unanimous vote the Board took the application under advisement. After some discussion during which it was brought out that the area was zoned for General Business and that there is a definite need for lower income rental units such as these in town, Donald Scott's motion to GRANT was seconded by Daniel T. O'Leary and so voted unanimously with the provision that Building Inspector Charles H. Foster be consulted about adequate exits. Reasons for granting were that the requested variance will not be in substantial derogation from the intent or purpose of the Zoning By-Law. The requested variance will not adversely affect the public good to any substantial extent and will not materially affect the general character of the neighborhood.
