Dear Sirs
The following petition was heard at a meeting of the Planning Board on Monday
evening, August k, 1969 at the Town Office Building. The members present and
voting were: William Chepulis, Jr., Chairman; Donald N. lveirstead, Secretary;
George B. Farley, Charles W. Trombly, Jr., Esq. and Robert J. Burke,
JOSEPH J. and PAULINE FLINN petitioned to subdivide a parcel of land containing
20 lots at the intersection of Boxford. and Forest Streets, containing approxi-
mately 22 acres and to be called 'Spinning Wheel Estates*. Atty. John J. Lynch
represented the petitioners, who were also present. Preliminary plans had been
presented to the Board previously and several recommendations and changes were
made on the Definitive plans, as requested. Several abutters present discussed
some of the wet land in the area and the responsibility of the developer con-
tacting the Department of Natural Resources if tire- development is approved. There
would be twX water since there is an 8* water main on Boxford Street which would
be extended to the development. Mr. Neirstead made a motion to take the petition
under advisement, Mr. Tronbly seconded the motion and the vote was unanimous.
A meeting was held on Monday evening, September 22, 1969 at which time the some
Board members were present and discussed and voted on the petition. Mr. Reirstead
made a motion to APPROVE the subdivision with certain modifications. Mr. Burke
seconded the motion and the vote was unanimous. In a letter dated September 30,
19699 the petitioner's attorney, John J. Lynch, granted a 30-day extension of time
in making a decision in order that the petitioner and Planning Board might discuss
a proposed suggestion contained in a letter dated September 4, 1969 from the Fire
Chief. After such discussion held on October 63, 1969s the Planning Board unani-
mously voted to sustain its original decisions as stated above.
The conditions are as followsa
1. That the record owners of the subject land execute and record a *covenant
running with the land* within 20 days from the date of this decision, or otherwise
provide security for the construction of ways and the installation of municipal
services within said subdivision, all as provided by G.L. c. 41, S. 81-J.

2. That all such construction and installations shall in all respects conform to
the governing rules and regulations of this Board.
3. Thaty as required by the Borth Andover Board of Health, no building or other
structure shall be built or placed upon lots as shown on said plan without the
prior consent of said Board of Health.
d. That stater and sewer will be according to the rules and regulations of the Board
of Public Works.
5. That surface drains and street bounds must be installed, and additional catch
basins installed between lots 3 and 4 as requested by the Flaming Board and Xghway
Surveyor. The roads must be hot-topped and constructed all in accordance with the
requirements under the Subdivision Rules and Regulations of the Planning Board.
Proper street signs must be installed. Sidewalks are to be installed on one side of
the roadway,
6. Must comply with the Board of Fire Bnginseral requirements as to the fire alarm
system.
7. The developer must contact the state Department of Natural Resources because
of the filling of the land that will be invo3vedo

Requirements as to the contents of "definitive plans":
G.L. c. 41, s, 81 0, briefly describes a "definitive subdivision plan" as "a
plan of such proposed subdivision, showing the lots into which such land is to
be divided and the ways already existing or which are to be provided..... for
furnishing access to such lots....." However, such a plan should also supply
the data required of "preliminary plans" under G.L. c. 41% s. 81 L, as follows:
"Preliminary plan" shall mean a plan of a proposed subdivision or resubdivi-
sion of land drawn on tracing paper, or a print thereof, showing (a) the
subdivision name, boundaries, north point, date, scale, legend and title
"Preliminary Plan"; (b) the names .of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the namRs of all abutters, as
determined from the most recent local tax list; (d) the existing and proposed
lines of streets, ways, easements and any public areas within the subdivision
in a general manner; (e) the proposed system of drainage, including adjacent
existing natural waterways, in a general manner; (f) the approximate boundary
lines of proposed lots, with approximate areas and dimensions; (g) the names,
approximate location and widths of adjacent streets; (h) and the topography of
the land in a general manner.

It should also conform to the rules and regulations of the North Andover
Planning Board relative to definitive plans, and to the requirements imposed
by law for the recording of plans at the Registry of Deeds.

Dear Sir:
A public hearing was held by the Board of Appeals on January L+, 1974 upon
application of JOSEPH J. FLYNN who requested a Special Permit under Section
4.122 (14) of the Zoning By—Law so as to permit the conversion of the third
floor to another apartment; located at 70.72 Pleasant Street. The following
members were present and voting: Frank Serio, Jr., Chairman; Dr. Eugene A.
Beliveau, Clerk; Louis DiFruscio, William N. Salemme and Associate Member
Alfred E. Frizelle, Esq. who sat in place of Member Arthur R. Drummond.
The hearing was advertised in the Lawrence Eagle—Tribune on Dec. 299 1973 and
Jan. 5, 1974. All abutters were duly notified by regular mail.
Mr. and Mrs. Flynn appeared in their own behalf and explained they wanted to
convert the third floor of the dwelling to another apartment, which would then
make five apartments. Bldg. Inspector Charles Foster said he inspected the
premises and explained that floor plans would not be necessary for the work that
is to be done; that the room sizes will not be changed. There is a large vacant
area of land which would provide more than enough room for parking. Mr. Foster's
letter of Jan. 14th made several suggestions as to fire safety requirements, etc.
There was no opposition to the petition; there were no abutters present.
Dr. Beliveau made a motion to take the petition under advisement and that the
Board view the premises; Mr. Salemme seconded the motion and the vote was unanimous.
At the Board's meeting held on February 119 1974, at which all of the same members
were present, further discussion was held on the petition. Atty. Frizelle made a
motion to Grant the special permit subject to the conditions as discussed; Mr.
Salemme seconded the motion and the vote was unanimous.
The conditions are as follows:
1. Eight paved parking spaces.

2. Fire protection subject to the recommendation of the Fire Chief, such as a
fire detector.
3. Four additional windows to meet Section 507.2 of the BOCA Code.
4. Other conditions as stated in the Building Inspector's letter of Jan. 14l
1974.
"Main partition between the stairways leading to the third floor must be
covered on one side by 5/8 .fire-code sheetrock, firestopping must be
installed at the second floor level between partition studs and two
1-hour rated fire doors must be installed at the bottom of the stair-
ways leading to the third floor apartment. These requirements will
meet the BOCA Code regulations for safe means of escape from the pro-
posed third floor apartment."
