Prior to signing the definitive plans all executed deeds of easements and parcels shall be submitted to the Planning Board and held in escrow until completion. At the time of completion and prior to final security release, the developer shall record said documents for the Town. C. A certified document shall be submitted to the Planning Board after the completion of each phase verifying that all utilities (including electric, telephone, sewer, and cable) have been installed prior to binder coat of application. Installation shall be in accordance with plans and profile prior to the release of any lots. 1 . Recorded plans shall be revised to show drainage easements with metes and bounds to include drainage to a waterway and include headwalls and detention ponds. 5. No lot (s) or group of lots will be released from the Statutory Covenant until all street utilities have been installed to the satisfaction of the Division of Public Works and further that certification and As-Built Plan and profile shall be submitted for approval to the Planning Board indicating that all drainage has be installed in accordance with the approved plans . In the event any drainage has not been installed with the approved plans, the Design Engineer shall substantiate with revised drainage computations that the incorrected installation shall not adversely effect any downstream abutter and/or the overall drainage design of the subdivision to the satisfaction of the Planning Board. The As-Built Plan and certification shall include all utilities installed within the street; including, but not limited to drainage, sewer, gas, water, telephone, fire cable and electric and further that all detention basins and off street drainage has been completed satisfactorily. No lot (s) or group of lots shall not be released from the Statutory Covenant until the binder coat of bituminous pavement has been placed to the satisfaction of the Division of Public Works and certification from the Design Engineer certifies the horizontal and vertical location of the binder coat is in conformance with the approved plans. 7. The As-Built and Acceptance Plans shall be accompanied by a Certificate of Compliance from a Registered Professional Engineer certifying that the grades on all lots and streets have been established in compliance with the Definitive Plans and that such grades do not create adverse drainage patterns onto adjoining lots, streets and/or abutters. 8 . Developer shall reserve the fee in the roadway from any lot conveyance. 9 . Candlestick Lane and Jerad Place Road will be constructed and brought to binder and connected to Forest Street prior to any construction being started on Sugarcane Lane, on lot 28 thru 37. 10 . The developer shall submit for approval to the Planning Board an erosion control plan. 11 . In accordance with the Rules and Regulations, there shall be no driveway curb cuts constructed in the locations of catch basins or stone bounds. Prior to release of any security any and all driveways so constructed, whether by the developer and individual owners, shall be removed and reconstructed elsewhere as approved by the Planning Board at the developers expense. This condition shall be placed in the Statutory Covenant. 12 . Granite curbing shall be installed along siding where roadway glrade is steeper than 4%. 13 . A bond in the amount of $24,000, for the As-Built Plans shall not be released until approved by the Planning Board. 14 . Proper sight distance easements will be provided as necessary and/or required at the roadway intersection with Forest Street. 15. The applicant shall confer with the Department of Public Works, the Highway Surveyor, the Tree Warden, the Fire Department and the Planning Board regarding the widening of Forest Street and the provision of safe access to the subdivision including adequate site distances. The Planning Board shall approve the final road alignment and insure that appropriate sight easements are obtained and recorded. Also, there shall be no tree cutting in the public way except as in accordance with MGL, Chapter 81 and the approved subdivision plan. 16 . Andover, MA 01810 * DECISION * * * The Board of Appeals held a public hearing on March 8, 1988, April 12, 1988 and April 26 1988 upon the application of Robert J. Janusz requesting a Special Permit from the requirements of Section 5, Paragraph 5.5 and 5.6 of the Zoning ByLaw so as to permit partial removal of a gravel esker which will be used in road construction on site on the premises located at Jerad Place 11. The following members were present and voting: Frank Seiro, Jr., Chairman, Walter Soule, Raymond Vivenzio and Louis Rissin. The hearing was advertised in the North Andover Citizen on February 18, 1988 and February 25, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit as requested, subject to the following conditions: 1. Section 5 of the Zoning ByLaws be adhered to, copy attached. 2. Traffic control required, subject to the decision of the Chief of Police. 3. Speed limits be reduced in area. 4. Signs be put up. (Section 6.6) . 5. Streets cleaned daily at end of workday. 6. Damage done to road be repaired by petitioner. 7. Bond for $10,000.00 be posted(5.4) . 8., Letter of Intent filed with the NACC and a request for a Determination of Applicability of the wetlands act be filed with the NACC and, any Orders of 'Conditions-be adhere$ to. Chairman /awt Attach. i SECTION 5 EARTH MATERIALS REMOVAL 5.1 General (1) Excavation, removal, stripping, or mining of any earth material except as hereinafter permitted on any parcel of land, public or private , in North Andover, is prohibited. (2) Exclusive jurisdiction to issue Earth Removal Permits shall be with the Board except for Permits allowed in Paragraphs 5.5 and 5 .6 . (3) The Board or the Building Inspector shall have the authority to issue an Operating Hours Ex- tension Permit, as defined in Subsection 5. 2 (4) The Building Inspector shall have the authority to enforce all conditions of any Permit issued under this Section on the Zoning By-Law. (5) All earth removal operations in in North Andover on the effective date of this section shall be subject to the requirements stated herein. However, all Earth Removal Permits issued prior to the effective date of this Section shall remain in effect until their expiration date and/or annual review. At such time, said operation shall be subject to the provisions of this Section, unless otherwise allowed by the Board, for a period not to exceed six (6) months. (6) An annual fee of One hundred dollars ($100.00) shall be required for Earth Removal Permits. Miscellaneous Earth Removal Permits shall require an annual fee of Twenty-five d811ars ($25 .00) . (7) Violation of this Section of the Zoning By- Law, notwithstanding the provisions of Section 10 .13, imposes a penalty of Fifty dollars ($50 .00) for the first offense, One hundred dollars ($100 .00) for the second and each subsequent offense. Each day of operation in violation of this section will be con- _sem.... sidered a separate offense. (8) Any sanitary landfill operated by the Town of North Andover shall be exempt from the pro visions of this Section. 5.2 Definitions (1) Applicant: the owner, or prospective owner by reason of a Purchase and Sales Agreement, of the- land shown by the plan submitted with the Earth Removal Permit Application. (2) Earth Materials: "earth materials" shall in- clude soil, loam, sand, gravel, clay, peat, rock, or other allied products. (3) Earth Removal Operations: the excavation, re- moval, stripping, or mining of any earth mater- ial on any site within the Town of North Andover. (4) Operating Hours Extension Permit: a Permit issued by the Board or the Building Inspector for an extension of the time of operation for trucking from' the site until 9: 00- p.m. (5) Board : Zoning Board of Appeals. (6 ) Permit: the word "Permit" in the Earth Removal Section shall mean and inlcude a Special Permit for earth removal as issued by the Special Permit Granting Authority. 5.3 Application for Earth Removal Permit (1) All applicants for Earth Removal Permits must submit seven (7) copies of the following information concerning the proposed site of the removal operation to the Board thirty (30) days prior to submission of an appli- cation for an Earth Removal Permit. The Board shall distribute the information to the Planning Board, Building Inspector, Conservation Commission, Board of Health, Highway Department, and Police Department, so that recommendations from these depart- ments may be submitted for the required public hearing. (2) A plan or plans to scale, (1"=401 ) prepared and stamped by a Registered Engineer, showing the property lines of the parcel of land under con- sideration along with all abutters to the property, existing and final contours in five foot (5 ' ) elevation increments, existing and proposed final drainage of the site, including all culverts, streams, ponds, swamps, and silta- tion basins, means of entrance and egress from the property, locus map, and any other perti- nent data deemed necessary by' the Board. (3) A plan, study, or report showing the proposed ultimate use of the land conforming with the existing Zoning By-Law. Proper planning for future land use shall be a prime consideration affecting thte issuance of an Earth Removal Permit. (4) A complete list of the names and addresses of current abutters of the property where such removal is proposed. (5) An operating schedule showing the active area (not to exceed five (5) acres) where the earth removal will begin and also how the total parcel will be developed in progressive five (5) acre increments. 5 .4 Permits for Earth Removal (1) The Board may issue Earth Removal Permits for any zoning district, complete with conditions imposed, for areas not to exceed forty (40) acres. All Permits shall conform to the minimum restoration and operating standards contained herein and such other conditions as the Board may deem necessary. Said permit shall allow the working of only five (5) acres at any one time. Upon completion of the earth removal operation on. a five (5) acre parcel, or a part thereof, and substantial restoration of said parcel as determined by the Board, according to the restoration standards at the Permit con- ditions, application may then be made to the Board for a Permit renewal. Such Permit renewal shall allow the removal of earth on another five (5) acre section, as shown by the operating schedule submitted with the Permit application. This procedure shall be followed until the operation is completed. i (2) The Permit shall be considered a non-trans- ' ferable revocable Permit to remove earth materials. It it is found that incorrect information was submitted in the application, or that conditions of the Permit are being violated, or that the governing regulations are not being followed, the Permit shall be suspended until all provisions have been met and the premises made to conform. Failure of the Permit holder to comply within the time specified by the Board for correction of violations shall cause the Permit to be revoked, forfeiture of the security to the Town, and the imposition of all fines as set forth in Paragraph 5 .1, (2) . (3) The Board shall discuss and review the permit periodically, and at a minimum, annually. Written progress reports showing conformance with regulations and Permit conditions shall be submitted to the Board by the Building Inspector or his designated agent every three (3) months. (4) An Earth Removal Permit shall not be in effect until the applicant has filed the proper security as required in Paragraph 5.9 , paid the required fees as required by Paragraph 5.1 (6) , and recorded the Special Permit at the Registry of Deeds. (5) Mechanical crushing and screening may be per- mitted by the Board after a public hearing with due notice given. 5.5 Earth Removal Incidental to Development, Construc- tion, or Improvement 4 (1) This regulation shall be deemed not to pro- hibit the removal of such sod, loam, soil, clay, sand, gravel, or stone as may be required to I be excavated for the purpose of constructing ways in accordance with lines and grades approved by the Planning Board, or for the purpose of constructing underground utilities. s : (2) Where soil is to be removed in connection with the preparation of a specific site for buildinge removal may take place only after the issuance of a building permit by the Building Inspector. . V. }s III Removal will be allowed only from the the area for the building, driveways, parking areas, and from areas where removal is specifically re- ,quired by the Board of Health in connection with disposal systems. Where special cir- cumstances exist requiring general regrading, removal of peat, etc. , the builder may file a plan and request for an additional soil re- moval permit with the Building Inspector as provided in Paragraph 5 .6 below. (3) Where excavation, removal, stripping, or mining of earth -on any parcel of land, public or private, is made necessary by order of any other Board or Agency of the Town, such exca- vation, removal, stripping, or mining, if in excess of one-thousand (1,000) cubic yards } shall be governed by the provisions of Section E 5.6 of this by-Law. (4) Excavation, removal, stripping, or mining of fi earth incidental to improvements shall be governed by the provisions of Section 5.6 of F this By-Law. (5) All earth removal, excavation, stripping, or mining as allowed under this paragraph shall be governed by the provisions of Section 5.6 of this By-Law. 5.6 Miscellaneous Removal of Earth (1) Excavation, removal, stripping, or mining of miscellaneous amounts of earth as allowed under Section 5 .5 is permitted provided the excava- tion, removal, stripping, or mining is necessary g for the improvement or development of the pro- perty on which the excavation or removal takes place. (2) Excavation, removal, stripping, or mining of aggregate quantities of less than fifty (50) cubic yards on any one general site requires no formal approval. Where the excavation, removal, stripping, or mining of soil is in quantities in excess of fifty (50) cubic yards - but less than one-thousand (1 ,000) cubic yards, application must be made to the Building In- spector for a Miscellaneous Soil Removal Permit. Where special circumstances exist which requires the excavation, removal, stripping, or mining 51 • I f i of soil in excess of one-thousand (11000) cubic yards, but less than five-thousand (51000) cubic yards, a Permit may be granted by the Board for such removal without a public hearing.) However, where the excavation, removal, stripping, or mining exceeds five-thousand (5 ,000) cubic yards, then a public hearing will be necessary and the Permit granted shall indicate the approximate quantity of soil to be removed, the purpose of removal, and the location of the site of removal. The Permit shall also specify that upon completion of excavation, exposed subsoil shall be graded and covered with loam to a minimum depth of six (6) inches and that the removal is to be controlled by the appro- priate section of Paragraph 5.7 (Operating Standards) . It is further provided that except where removal under this Paragraph is done in connection with the formation or enlargement of a pond, excavation- shall not be permitted below the mean grade of the street or road serving the property. The excavation of said pond in any event shall not be such as to change the direction or flow of a water course or to cause . surface water to gather as a sump or swale. Excavations for burying large rocks and stumps shall immediately be back-filled for safety reasons. Failure to meet the requirements of this Paragraph shall be deemed a violation of thte Zoning By-Law. 5.7 Operation Standards (1) Time of Operation. a) Excavation and site maintenance may be carried on from 6: 30 a.m. until 7: 30 p.m. , Monday through Saturday. b) Trucking from the site may be carried on ' from 7: 00 a.m. through 6: 00 p.m. , Monday through Saturday. c) An Operating Hours Extension Permit for trucking until 9: 00 .m. for no more than t p g three (3) consecutive days may- be granted by the Building Inspector after reviewing conditions of the application. Said appli- cation shall show reason for extension of time, distance of hauling, and approximate cubic yardage to .be hauled. (2) Site Preparation. p anon. a) Only the active area described in the Permit application may be made ready for earth re- moval. b) No standing trees are to be bulldozed over, or slashed and bulldozed into piles. All trees must be cut down. All wood and brush must be piled for removal or chipping. Wood chips may remain on the site. No trees are to be buried on the site. c) Stumps shall be buried in predesignated areas as shown on application plans. d) Any change in stump burial must be sub- mitted to the Board for approval. (3) Topsoil Storage. a) All topsoil removed from the active removal area shall be piled for future site restora- tion. b) No topsoil shall be removed from the site until all areas have been restored and per- mission has been granted by the Board. (4) Erosion control. a) Prior to any excavation or or earth removal, adequate siltation basins shall be con- structed to prevent the run-off of silted water from the site. b) All excavation shall be done so as to create contours to channel run-off waters into the siltation basins. c) No siltation basin shall exceed seven (7) feet in depth. d) Siltation basins must be cleaned when sedi- ment deposits are within eighteen (18) inches of the outfall invert. (5) Dust Control. a) No earth removal operation shall create ex- cessive amounts of dust or allow roads leading into or from a site to become ex- cessively dust producing. b) Proper dust control methods shall be approved by the Building Inspector. (6) Excavation Near Brooks. a) No excavation shall be made which will alter the natural way or existing elevation of a brook, stream, or river. b) All banks of brooks, streams, and rivers shall be reconstructed to be aesthetically attractive and of sufficient height to prevent abutting properties from flooding. c) Said bank height shall be computed, for a fifty (50) year storm for all brooks, streams, and rivers up to eight (8) feet in width and two (2) feet in depth; and for a one-hundred (100). year. storm for all brooks, streams, and rivers which exceed this size. (7) Site Screening. a) An immediate program of site screening shall start when site preparation begins. b) All entrances shall be screened with exis- ting vegetation, evergreens, or other suitable natural methods, so as to prevent a direct view into the earth removal area. c) All areas within fifty (50) feet of a traveled way or abutting property lines shall be reforested immediately upon com 1 n Petio of the earth r emoval 'oper oof that area. Said reforestation shall done in accordance with the North Andover Tree Department. A minimum of One Hundred-fifty (150) trees per acre shall be used for this reforesta- tion. Areas which are to be used—for—agricultural purposes after earth removal operations are completed may be reforested in the following manner : Trees shall be planted twenty-five (25) feet deep from the road or property line. The remaining area shall immediately be planted with grass or other suitable agri- cultural planting material. (8) Access Roads. a) All access roads shall be level with inter- secting, streets for a distance of sixty (60) feet. b) A STOP sign shall be installed so as to warn any vehicle entering onto a Town street. c) All access roads shall be equipped with a suitable locking gate to prevent unauthori- zed entry. (9) Site Maintenance. a) No open face excavation shall exceed twenty- five (25) feet in height. b) No excavation shall be closer than fifteen (15) feet to a property line. c) No slope shall exceed a two (2) foot hori- zontal to a one (1) foot vertical (2:1) grade. (10) Temporary Buildings. a) All temporary structures shall be specified in the Special Permit application and shown on the plan. b) Any structure erected on the premises for use by personnel or storage of equipment shall be located at least forty (40) feet from any existing roadway and at least thirty (30) feet from any lot line. c) Any temporary structure will be removed no later than ninety (90) days after the ex- piration date of the Permit. (11) Mechanical Crushing and Screening. a) All crushing and screening Permits shall be granted for a period not to exceed six (6) months. b) Said Permits shall be granted as a cleanup procedure only. c) Washing of processed material will not be allowed. d) Operation of crushing or screening equipment shall be from 7: 30 a.m. until . 5:00 p.m. , Monday through Friday. e) All crushing and screening equipment shall be equipped with suitable dust and noise control devices. 5.8 Restoration Standards (1) All restoration must be completed within sixty (60 ) days after the termination of an Earth Removal Permit or by the first of June if the Permit terminates between December first through March thirty-first. (2) No slope shall be left with a grade steeper than a two (2) foot horizontal to a one (1) foot vertical (2:1) . (3) All siltation basins shall be filled with earth, and a natural drainage pattern must be re-estab- lished. No area upon the site which will collect water shall remain unless approval is granted by the Board or unless the area was shown on the original application plans. (4) All topsoil which was on the site prior to -earth removal operations shall be replaced to a minimum depth of six (6) inches on all disturbed areas. Sites that had less than six (6) inches of topsoil shall be restored with a minimum of four (4) inches over the entire area. (5) Seeding - The entire area shall be seeded with grass or legume which contains at least sixty percent (60%) perennials. The planted area shall be protected from erosion during the es- tablishment period using good conservation practices. Areas which washout are to be re- paired immediately. (6) Reforestation - All areas which are disturbed in the earth removal operation shall be re- forested with fifty percent (50%) coniferous and fifty percent (50%) decidous trees planted at the rate of one hundred fifty (150) trees per acre. All trees used are to be a minimum of two (2) year transplants. Said planting shall be in accordance with the recommendations of the North Andover Tree Department. Areas which are to be used for agricultural purposes after earth removal operations are completed may be reforested in the following manner : a) Trees shall be planted twenty-five (25) feet deep from a public road or property line. b) The remaining area shall immediately be planted with grass or other suitable agri- cultural planting material. Permits issued by the Building Inspector for soil removal incidental to construction or for special purposes are exempt from reforestation para- graph. (7) Within ninety (90) days of completion of opera- tions, all equipment, accessory buildings, structures, and unsightly evidence of operation shall be removed from the premises. 5.9 Security Requirement (1) There must be filed with the Town Treasurer, a continuous bond or deposit of money in the minimum amount of One thousand dollars ($1000) per acre to be excavated, and shall be of a sufficient amount to cover ten (10) acres, or the total parcel, whichever is smaller, as determined by and satisfactory to the Board. (2) After completion of the total project, and at the applicant' s written request, the Board may grant a partial release of any security posted by the applicant. one (1) year after such a _ partial release is granted and if in the opinion of the Board, no damage or deterioration to the finished project has developed, the Board will issue a final release of the security. rf, during the year following the date of a partial release, slumping, gullying, erosion, or any other unsatisfactory condition appears, the applicant shall be responsible for, and shall make any necessary repairs, before final release of security is granted. All Planning Board order of conditions are to be placed on the recorded definitive plan, (cover sheet) prior to signature at a Planning Board Meeting. B . Prior to signing the definitive plans all executed deeds of easements and parcels shall be submitted to the Planning Board and held in escrow until completion. Each dwelling unit will be serviced by its own driveway across it's own lot from the street where it has legal frontage unless otherwise approved by the Planning Board. Any driveway easement in the Subdivision must have Planning Board approval. 6. Temporary cul-de-sac language for the easement should be included. Note on the recorded plan that the Sugarcane Lane may become a through Street in the future under the Subdivision v Control Law. The as-built plan and certification shall include all utilities installed within the street, Including , but not limited to drainage, sewer , gas, water , telephone, fire, cable and electric and further that all detention basins and off street drainage has been completed Satisfactorily. 10. No lot (s) or groups of lots shall be released from the Statutory Covenant until the binder coat of bituminous pavement has been placed to the satisfaction of the Division of Public Works and certification from the Design Engineer certifies the horizontal and vertical location of the binder coat is in conformance with the approved plans. 11. No lot (s) or group of lots shall be released from the Statutory Covenant unless the Conservation Commission has approved such lot construction and has issued either a Negative Determination or an Order of Conditions on such lot or if neither is applicable has informed the Planning Board that such lot is not governed by Chapter 131. 12. The As-built and Acceptance plans shall be accompanied by a Certificate of Compliance from a Registered Professional Engineer certifying that the grades on all lots and streets have been established in compliance with the Definitive Plans and that such grades do not create adverse drainage patterns onto adjoining lots, streets and/or abutters. 13. Developer shall reserve the fee in the roadway from any lot Conveyance. 14 . The Record and Topographic plans will indicate the 100 year flood elevation in each respective area that is subject to flooding in accordance with the rules and regulations. 15. Candlestick Lane and Jerad Place Road will be constructed and brought to binder and connected to Forest Street prior to any construction being started on Sugarcane Lane. In other words, the through road is to be in place prior to any other roads. . 16 . The developer shall submit to the Planning Board an erosion control plan. 17. In accordance with the Rules and Regulations, there shall be no driveway curb cuts constructed in the locations of catch-basins or stone bounds. Prior to release of any security, any and all driveways so constructed, whether by the developer and individual owners, shall be removed and reconstructed elsewhere as approved by the Planning Board at the developers expense. This conditions shall be placed in the statutory covenant. 18 . Plans will indicate the installation of the water main on the profile sheets in accordance with the rules and regulations. 19 . Additional hydrants may be required at the front of any lots that will have dwellings situated more than 300 feet from the street line with the approval of the Fire Chief. 20 . Definitive construction plans and specifications are to include existing topographic data, top of headwall elevations for the wetland crossings on lot 23 and lot 37 . The developer will provide cross sections. 21. Granite curbing shall be installed along siding where roadway grade is steeper than 4% . 22. The catch basins drainage in front of lot 9 on Jerad Place I plans shall be shown on Jerad Place II plans between lots 10-A and 9 . There should be two catch basins, only one is shown. 23. A bond in the amount of $24 ,000 shall be posted for the as built plans, based on their acceptance. 24. All test pit data including spring water tables will be shown on the Definitive Plans. 25. Proper sight distance easements will be provided as necessary and/or required at the roadway intersection with Forest Street. 26. The applicant shall confer with the Department of Public Works, the Highway Surveyor, the Tree Warden, the Fire Department and the Planning Board regarding the widening of Forest Street and the provision of safe access to the subdivision including adequate site distances. The Planning Board shall approve the final road alignment and insure that appropriate sight easements are obtained and recorded. Also, there shall be no tree cutting in the public way except as in accordance with KGL, Chapter 81 and the approved subdivision plan. 27 . The applicant shall comply with the Tree Wardens recommendation dated April 30 , 1986 requiring security in the amount of $14 ,000 to preserve existing trees and for new planting. 28. In accordance with the Fire Chiefs recommendations: - Fire hydrants must be installed at 500 foot intervals. - Hydrant shall be relocated to the end of the cul-de-sac of the proposed subdivision. - Lot numbers are to be posted during construction. - Permanent house numbers shall be posted on dwellings prior to occupancy. - No open burning is to be permitted except during open burning season under the Fire Departments regulations. - All builders must comply with the Fire Departments underground fuel storage regulations. 29 . A definitive plan submittal shall provide a detailed program of phasing the total development acceptable to the Board. No construction shall take place prior to endorsement of said program. 30 . A detail tree plan in accordance with Section V,R, and IV.1 shall be submitted with the definitive plan for review and approval by the Planning Board and Tree Warden prior to endorsement. Said plan shall be designed to preserve existing trees as much as possible. 31. A stump pit burial plan shall be submitted to the Board and Highway Surveyor for review and approval prior to any on site construction. 32. Definitive subdivision plans of Phase I and Phase II show different property lines and appear to subdivide and landlock other land of the developer to the rear of lot 27 . Applicants professional land surveyor will clarify and certify to the Planning Board' s satisfaction where the Janusz property lines lie and adjust as necessary to include all property of the applicant for further review of the Planning Board. The plans Shall show the balance of the Janusz property, and demonstrate that there is legal frontage and that the property is not landlocked. This information may be shown on the key map. 33. Drainage computations as submitted for the Definitive subdivision plan are unacceptable to the Planning Board for the following reasons: 1. Pages shall be numbered and ponds referred to will be labled. 2. Computations will be provided for stage storage discharge of the various detention ponds. 3. Detention pond at lot 23 does not appear to contain the correct watershed area and no comparison for existing flows at this design point is presented therefore it is unclear whether or not this detention pond is mitigation. 4. Runoff of lots 8 & 9 of Phase I and of lots 26 , 27 and 28 of Phase II flow unmitigated into the Mosquito Brook wetland area. The applicant is required to mitigate the increased rate of runoff from development of these lots on Phase II , Phase I stands by itself and can not be used for Phase II since this sites runoff bypasses the detention on Phase I and rather a portion of Phase I may indeed flow onto Phase II . Insufficient data has been presented to prove otherwise. 5. Drainage computations are also unacceptable due to the fact that 13 of the proposed 26 lot subdivision has runoff directed away from the detention ponds and mitigation is not addressed in those areas. 34. revision to the Definitive subdivision plans do not preclude the possibility that the Planning Board will not have additional comments on impacts of revisions or changes. 35. Any changes in the approved definitive plan which occurs during construction in regard to the road profiles, horizontal or vertical locations of drainage and any other roadway changes, will be brought to the Planning _Board for review prior to implementation. 36 . Adequate sidewalks shall be provided by the applicant at the discretion of the Planning Board after it receives input from the Department of Public Works and other pertinent town departments concerning the need for sidewalks in this section of Town. 37 . 1n order to provide for the common welfare, convenience and safety of future inhabitants of the subdivision, and to preserve important site features, the applicant shall submit to the Planning Board for its approval an appropriate plan which provides for open space for parks and/or recreation. 38 . ' A. Plan Information 1. Present and proposed topography are shown at a two foot contour interval . A graphic drainage configuration ' is shown on the drawings and is complimented with an associated Hydrologic Report. 2. The site is completely moderately wooded with little underbrush. The surface of the ground is -sloping from west to east down to the watershed of Mosquito Brook. There are no outstanding tree groupings on the site which ' should be preserved. The wetland associated with Mosquito Brook is significant and does contain botanical features and wildlife habitat potential which should be protected ' during constuction. 3. Most of the soil in the area being subdivided has been observed by digging several deep holes to identify soil structure and seasonal high water table. See test pits attached. t 4. Soil types and Hydrologic Soil Groups are shown on the drawings associated with the Hydrological Analysis. B. Physical Environment The general characteristic of the site is rural. The abutting land to the East and South is underdeveloped. The land to the Northwest along , Forest Street contains single family homes with frontage on Forest Street. To the North is Candlestick Road, a development of single family homes entering from Salem Street, and Jared Place, Phase I, containing 14 lots. The site is physically comprised of gentle sloping land to steep banks with streams leading down to the wetlands associated with Mosquito Brook. The upland is a very suitable candidate for single family development. ' C. Surface, Water and Soils 1. There are wetlands surrounding and traversing through the proposed development. The wetlands shall be used as Detention Basins in specific locations in order to ' control the peak rate of runoff leaving the site. The surface runoff characteristics are shown on the Hydrological Drawings. The wetlands shown will be the receiving bodies for pre and post development runoff . ' I With the use of the Detention Basin there will be no increase in the peak rate of runoff leaving the site. i 2. During the construction the developer will install a row of staked hay bales in specific locations to control sedimentation and erosion from entering the wetlands. A triple row of staked hay bales backed up by a filter fabric fence shall be installed perpendicular to the inlet outfill of the Detention Basin as shown. This system ' shall be maintained throughout the duration of construction. As a secondary provision to control sediments from entering the significant wetlands associated with Mosquito Brook an inverted elbow shall be installed ' at the inlet of the outlet pipe leaving each Basin. This elbow shall be made of 12" diameter corrugated metal pipe with 4 one inch diameter holes drilled at specific ' elevations and shall contain a baffled top. 3. All detention basins have been designed to detain t the increase in the rate of runoff during a 10 year and 100 year, Type II, storm event. The basin shall be a permanent mitigation device. The basin should not require regular annual maintenance since we do not anticipate ' the post development sedimentation to be of significant volume. After several years however the basin will require a surface cleaning. ' The• proposed •grading is shown on the "Topography and Utility Drawings" in order to construct the roadway and appurtenances. Approximately 50% of the lot areas will ' be disturbed to construct the homes, drives and install proper landscaping features. Some large cuts and fills are required to develop the site, but specifically to where roadways cross wetland channels. No waivers for the construction of the roadway is required, i.e. , slope, grade. ' 4. Sewage Disposal shall be provided by conventional subsurface means. Each dwelling shall have its own septic system. Each system shall be designed in strict accordance ' with the State Environmental Code (Title V) and the local Board of Health Regulations. No system shall have an impact on any surface water, soils or vegetation existing on the site. D. Subsurface Conditions The soils on the site are considered well drained. (See Soil portion of Hydrology Report) . The ground where tested was comprised of sandy soils. Groundwater will not pose a limitation during construction. Since all sewage disposal systems will be designed in strict accordance witht he health regulations, they will have a slight impact on the quality of subsurface water. i E. Town Services Candlestick Road Extension is about 1250 feet (Jerad Place Phase I) and will access and egress onto Candlestick Road on to Salem Street to the North of the site. Salem Street is a secondary road with large traffic volume capacities. ' Jared Place Phase I proposes 14 additional lots which will generate 168 vehicle trips per day. Jerad Place Phase II shall contain an additional 32 lots which will generate 384 additional vehicle trips per day. (Insert ' A-over) . The road will have town water and town drainage. Water will be extended from Candlestick Road to Forest Street. This shall provide a beneficial loop for both water supply and fire protection. Drainage all flows to a Detention Basin. The drainage system is typical of town roads, and will be maintained by the Highway Department. The subdivision will impact the DPW and Highway Department' s work load and maintenance requirements. With the roadwork now connecting to Forest Street, servicing the new roads shall be easier than the existing cul-de- sac network. There are no unusal service or maintenance problems associated with the proposed new roadway. The subdivision has the potential of generating about ' 100 children who primarily will attend public schools. No indication was made by the School officials whether this number will pose a significant problem to the school ' system. General Impact We feel this subdivision has been intelligently designed. Provision for future extension to Forest Street has been made by a previous "Form A" plan. The wetlands on the property have been protected by this design and by the use of a "frontage acception lot" . The development has been designed to have no increase in the peak rate of runoff leaving the site, post development. The soils are suitable for disposal of sanitary wastes and all dwellings will be served by Town Water. The site is comprised of forest areas and shrub areas, both underlain by moderately well-drained soils and wetland areas ' with poorly drained soils. Classification of soils were determined by the Soil Conservation Soil Survey Maps of 1981 . The purpose of this analysis has been to design structural onsite drainage which complies with Planning Board criteria while limiting off-site runoff discharge to below existing rates . The DRAINCALC Computer Model, an intensive flood routing ' program which incorporates SCS methods and standard hydraulic relationships, has been used to model existing and post-development hydrology and to size and design the storm ' drain system. The model develops hydrographs for each subcatchment area within the watersheds, routes them through channel reaches, pipes and detention areas with controlled outlets and integrates them to generate composite hydrographs. ' The model also prints out summaries of subcatchment input data and tabulations of detention (storage) pond inflow, stage and storage volume at small time increments during the modelled storms. The storm drainage pipe network was designed for a 10 year storm event. The culverts carrying existing water courses under proposed roadways were designed for 100 year storm event. This criteria is required according to the ' Subdivision Rules and Regulations. The hydraulic analysis was broken down into four design points: Design Point #1 - wetland swale at east side of Lot #28 . ' Design Point #2 - wetland swale at south side of Lot #31 . (Both design points drain to wetlands, southeast side of site. ) Design Point #3 - 12" culvert under Forest Street, south of Jerad Place Road. Design Point #4 - 12" culvert under Forest Street, north of ' Jerad Place Road. (Both design points drain to the west side of Forest St. ) Since both Design Point #1 and Design Point #2 drain to the same area then the increase in runoff at Design Point #1 can be compensated by the decrease in runoff at Design Point #2 . ( See post development hydrographs. ) The increase in runoff at the Design Point #1 and Design Point #2 is mitigated by draining through the wetland areas leading to the culverts.
