Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
Aprilj8, 1985 upon the application of Brian Ford. The hearing was
advertised in the Lawrence Eagle Tribune on March 22 and 29, 1985
and all abutters were notified by regular mail . The following
members were present and voting: Frank Serio, Jr. , Chairman;
Alfred E. Frizelle, Esq. , Vice Chairman; Augustine W. Nickerson,
Clerk William J. Sullivan; and Walter F. Soule.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit
relief from the sideline setback requirement to allow the con-
tinued existence of a garage on premises located at 197 Campbell
Road.
The petitioner testified that a garage was constructed 22 feet
from the side lot line where 30 feet is required. The garage was
constructed in accordance with a building permit issued by the
North 'Andover Building Department. When a plot plan was recently
drawn and a building permit was applied for to construct a
swimming pool , the violation was discovered. There is a vacant
parcel of land abutting the side of the lot where the violation
exists .
Mr. Charles Foster , Building Inspector, testified that his de-
partment issued the building permit to construct the garage 20
feet form the side lot line and asked that the Board grant the
variance to correct the error .
No opposition was voiced at the hearing.
Upon a motion made by Mr. Sullivan and seconded by Mr . Frizelle,
the Board voted unanimously to grant the variance as requested.

In granting the variance, the Board finds that Section 10.4 of the
Zoning By Law has been satisfied. Specifically, the Board finds
that relocating the garage would create a substantial financial
hardship to the petitioner .
Further, the Board finds that the violation is slight and that the
variance will not cause a detriment to the neighborhood since the
encroachment abuts a vacant parcel of land.
Said -#ariance, in the opinion of the Board, will not derogate from
the intent and purpose of the Zoning By Law.
