Petition #2-175 Mr. John J.; Lyons, Town Clerk Town Building North Andover, Massachusetts Dear Sir: A public hearing was held by the Board of Appeals on February 10, 1975 upon application of ARTHUR S. FUNDEKLIAN who requested a variation from the provisions of Sec. 6.3 and Table 2 of the Zoning By—Law so as to permit the erection of a garage and enclosed porch on the east side of the dwelling located at 121 Campbell Road. The following members were present and voting: Alfred E. Frizelle, Acting Chairman; Dr. Eugene A. Beliveau, Clerk; William N. Salemme and James D. Noble, Jr., Asso. Member. The hearing was advertised in the Lawrence Eagle—Tribune on January 25 and February 1, 1975 and all abutters were duly notified by regular mail. The dwelling is located on the lot in such a way that construction as proposed would place the addition closer to the side lot line than is required under the By--Law. During the hearing, the Petitioner testified that it would be impossible for him to place the,addition tothe rear of his house since the septic system is located in the rear; it would also be impossible to place the addition in the front of the dwelling since the home is served by a well located in the front yard; as to the west side of the dwelling, the Petitioner stated that this would require extensive remodeling. At the hearing the Building Inspector stated that the probable reason for the dwelling being located close to the side lot line is because a great amount of ledge is located in the area. After viewing the site and discussion, the Board voted unanimously to MUM the variance as requested pursuant to Seo. 9.5 of the By-Law. In granting the variance the Board determined that each of the conditions set forth in Sec. 9.5 have been met. The dwelling which was purchased by the Petitioner is located close to the lot line. It is impracticable to construct the addition any other place M March 24, 1975 Arthur Be Fundeklian as indicated above. To allow the variance would not'affect the zoning district nor derogate from the purpose of the Bye-Law. The property is located in the country and the other conditions o n f the By-Law as to size of the lot would still be maintained. Furthermore, there is sufficient distance between the proposed addition and an adjacent dwelling. The Board also determined that to require the Petitioner to construct the addition in any other location would impose a financial burden on him and accordingly voted to approve the variancee Very truly yours, BOARD OF APPEALS Alfred E.
