Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, February 6, 1967 at the Town Office Building and adjourned to the Fire Station Meeting Room due to the large number of people in attendance for the eveningfs hearings. The members present and voting weres William Chepulis, Jr., Chairman; Howard Gilman, Secretary; James M. Barman and George B. Farley. WALTER S. GREEN petitioned to amend the North Andover Zoning By-Law and the Zoning Map of the Town by changing from Country Residence District to Village Residence District a parcel of land owned by the City of Lawrence Airport Commission between Sutton Street and Chadwick Street and bordering the Town of North Andover Play- ground. Atty. Harold Morley, Jr. represented the petitioner. The land involved is owned by the Lawrence Airport and they no longer need the land for their purposes. Mr. Green has an option on the land which is still in effect. Where sewerage is available it should be zoned as Village Residential since a larger lot area is not needed for septic tank purposes. He would keep it a residential area. Village Residential land abuts this Particular area. Atty. Donald F. Smith, representing a number of abutters and residents in the area, spoke in opposition to the re-zoning. They are not opposed to the land being developed but are opposed to the manner in which it is being done - it is not to the best interest to the welfare of the Town. There would be too much congestion if smaller lots were allowed. It will not promote the safety,health and welfare of the surrounding area and the Town as a whole and would increase the flow of traffic. Chadwick Street is already too dangerous. There would be twice as many families, school children, etc. The people would like to see a nice development but not in small lots. He said this re-zoning is just for the economic advantage of one person, which is not reason enough to change the Zoning By-Laws. f Mr. Farley made a motion to take the petition under advisement. Mr. Gilman seconded the motion and the vote was unanimous, -2- February 10, 1967 In Executive session the Board discussed and voted on the petition. Mr. Barman made a motion to recommend PIIS-APPROYAL of the re-zoning of this parcel of land. Mr. Chepulis seconded the motion and the vote was unanimous. The Board gave the following reasons for dis-approvals 1. The ]Board feels that this land should conform with what exists in the area now. 2. This area is not suitable for high density housing. GREEN petitioned to amend the North Andover Zoning By-Law and the Zoning Map of the Town by changing from Country Residence Zone to General Business District a parcel of land at the corner of Turnpike and Peters Streets, containing approx. 3 acres. Atty. Thaddeus Palys represented the petitioner. He contemplates a complex for this area which would be of Colonial design. He has commitments for a local bank branch, an exclusive women's shop and the petitionerts own real estate office. There would be no restaurant or hamburger stand or something of that nature. It would contain mostly office space and the complex would facet Peters Street. It would benefit the tax base of the Town and would not burden the schools. Two other persons spoke in favor of the re-zoning. Films were shown of a similar complex. Atty. John P. Ford, representing Merrimack College, spoke in opposition to the re-zoning. He thought this change would be detrimental to the best interests of the town of North Andover or of the general area. Anthony Lennon, Turnpike St., was also opposed stating that the intersection is a dangerous one and a complex such as is proposed would increase the traffic hazards. They feel that there is already enough business in the area. Mr. Bannan made a motion to take the petition under advisement. This area is unsuitable for residential developiant. 2. It is in a completely business location. 3. The re-zoning of this area would be beneficial for that area and for the Town.
