Re: Subdivision Greenwood East Dear Bill: I have gone over the plans and walked the site of this pro- posed subdivision and my main concern is the drainage involved in this area. I would require having a twenty foot drainage easement deeded to the Town of North Andover from the south side of Chestnut Street to the headwall at the brook where the drainage from the subdivision will empty out. I would also like to have an eighteen inch R.C. pipe from the basin on Chestnut Street through the drainage easement to the point of the headwall at the brook. This is only a partial plan, and development of the adjoining land will necessitate more drainage than the twelve inch pipe shown might accommodate. The eighteen inch pipe would insure us of possible future drainage needs. I would also like to mention as a reminder to the developer that the new regulations added to our present Rules and Regulations and Inspection Form will be used on the proposed subdivision. The Highway Surveyors recoamiendaticns were not taken into account as follows: - the location of all catch basin shall be approved by the Highway Surveyor, including catch basins at the intersection with Kara Drive. - Sloped granite curbing shall be required on all grades in excess of 5%. 2. The Fire Chiefs request that Fire hydrants shall be placed at 500 foot intervals and at the end of the cul-de-sac. 3. The Police Department's recommendations were not taken into account: - A stop sign and a stop line shall be placed at the intersection of Kara Drive and proposed street. - School bus stops shall be identified and provided where needed as deemed by the police department. 4. List of abbutters and their addresses were not submitted. 5. Proposed ROW was not identified by name and width and shall be placed on Plans. 6. The length of the proposed roadway exceeds the maximum allowed in the Sudivision Rules and Regulations. A detailed waiver request was not submitted which will justify the additional length for planning board approval. 7. Documentation for the exisitng easements and structures to be removed was not submitted for review and approval by the Planning Board. 8. No lots shall be released from the Covenants running with the property until the following is completed: - All drainage is constructed in accordance with the subdivision plans including binder coat application, all utilities, including but not limited to fire alarms, water lines, sewer, drainage, electric, gas, cable shall be installed in accordance with the plans. 9. Proper measures to mitigate runoff and erosion runoff and to prevent damage to lots located downhill from the construction site was not submitted to the Planning Board's satisfaction. The applicant shall use the natural stone wall as an erosion control and not disturb any vegetation on the downhill side of said stone wall. There shall be no point discharge from any drainage pipe exiting toward any abutter. 10. The applicant shall be aware of the existing drainage problem on the Kara' Drive drainage discharging toward the Giard property. No mitigation plan was submitted to relieve and rectify this problem and therefore the Planning Board will not allow additional runoff into this Y drainage system. 11. A detailed tree plan in accordance with Secion V, R and IV.1 has not been submitted with the plan for review by the Planning Board and the Tree Warden. 12. A stump pit burial plan has not been submitted to the Planning Board and Highway Department for review and approval prior to any on-site cons"uction. 13. The applicant shall be advised that in the event a Definitive Plan evolves from this Preliminary Plan and/or parcel of land, the North Andover Planning Board will require upon submittal that all aspects of the Rales and Regulations governing the Subdivision of land must be strictly adhered to and will be a requirements notwithstanding this decision and the applicant shall comply with the Tree Department's reccrmiendation to preserve existing trees and to bond for new planting. 14. The applicant has not submitted a detailed phasing plan for the development of the subdivision which meets the satisfaction of the Planning Board. Due to the steepness of this site which drainns toward existing abutting dwellings on both sides, the Planning Board shall require stict adherence to a phasing plan which mitigates erosion by restricting vegetative removal throughout the subdivision. 15. The applicant has not provided documentation to the Planning Board that the owner/developer owns all the land in fee from Tiara Drive and further owns the rights to all the easements as shown on the plan. 16. Roadway cross-sections, including grading, do not reflect compliance with the Planning Board's rules and regulations. 17. There shall be no comm driveways within this subdivision. 18. No documentation has been provided to the Planning Board that a water pumping station has met the approval of the Division of Public Works and Fire Department. Detailed and approved plans will be required along with approved covenants that hold the Town of North Andover harmless in any manner. Said covenants must meet the approval of Town Counsel. 19. The existing tower, including the tower stays, shall either be removed from the Subdivision or enclosed within an easement and chain link fence. Said fence to meet the safety requires of the Building Dept. and Police Safety Officer. If enclosed within an easement and fence, no portion of the enclosed area shall be used for computation of abutting lots area. 20. The applicant has not documented that the existing drainage on Chestnut Street is capable of carrying the increased rate of runoff from the subdivision including the open waterway at the end of the drainage pipes. 21. The proposed profile does not mmeet compliance with the rules and ` 14 regulations in that a proper levelling area has not been provided. 22. The plan, as submitted, does not show adequate access to the proposed lots. The powers of a planning board (...under) the subdivision control law shall be exercised with due regard for the provisions of adequate access to all of the lots in a subdivision by ways that will be safe and convenient for travel...and for coordinating the ways in a subdivision with each other and with the public ways in the...or town in which it is located and with the ways in neighboring subdivisions. (Chapter 41, Section 81M, M.G.L.) Lyon, Town Clerk Town Building North Andover, Massachusetts Dear Sir: The following petition was heard at a meeting of the Planning Board on Tuesday evening, April 22, 1975, at 7:30 P.M. in the Fire Station Meeting Room. The following members were present and voting: William Chepulis, Chairman; Paul R. Lamprey, and John J. Monteiro. The meeting was tape recorded in order that the two absent members, Messrs. Ostherr and Salemme, would be aware of what transpired and be able to vote on the subject. Frank C. Gelinas, representing Greenwood Associates, petitioned for a subdivision of a parcel of land containing approximately 5 acres situated on Chestnut Street to be subdivided into 5 lots. Mr. Gelinas presented plans to the Board. He stated that the project would be a 5—lot subdivision with 500 feet of roadway approximately 600 feet from the intersection of Chestnut Street and Hillside Road. All lots are in conformance with present zoning. These lots will be sewered and public des will be provided. Philip Busby, Sr., 303 Chestnut Street spoke in reference to the acreage diagonally across from the proposed subdivision. He contends that the area is wet and marshy and is concerned mainly with the drainage. There was no opposition. At a meeting held on May 5, 1975, at which all members were present except Mr. Chepulis, Mr. 0stherr made &emotion to approve the subdivision named Greenwood East subject to the conditions listed below. Mr. Lamprey seconded the motion and the four members voted in favor. 1. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G .L. as 41, s. 81-U. 2. One is to fill the roadway from station 1 + 50 to station 4 + 0. The other alternative is to obtain an easement through abutting property to the Hillside Road sewer. We strongly recommend the developer persue one of the above alternatives rather than a lift station. The expense incurred to the town in maintainence and operation costs for the existing sewage lift stations indicates that the benefits obtained from these stations do not offset the cost.
