Dear Sir:
A public hearing was held by the Board of Appeals on December 129 1977 upon application
of Wayne & Jean Greenwood who requested a variation of Sec. 6.3 & Table 2 of the Zoning
By-Law so as to permit the erection of a 2-car garage located at 32 Magnolia Drive.
The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E.
Frizelle, Vice-Chairman; James D. Noble; R. Louis DiFruscio, Clerk and Ralph R. Joyce.
The hearing was advertised in the Lawrence Eagle-Tribune on November 26 & December 3,
1977 and all abutters were duly notified by regular mail.
Mrs. Greenwood appeared on her own behalf and presented a plan of land entitled "Plan
of Land located in North Andover, Mass. owned by Wayne Greenwood, dated Nov., 1977,
Francis E. Griggs, Jr., Registered Land Surveyor". The submitted plan showed the lot
and an existing house in full compliance with the North Andover Zoning By-Law. It
was proposed to add a garage to this dwelling which would be in violation of the side
setbacks in the area. Mrs. Greenwood suggested that there was a slight curvature in
the road whereby the lot line cut back across the lot at an angle such that the garage
could not be situated except as proposed on the said plan and still be in compliance
with the zoning laws. The Board made a determination that due to the shape of the lot,
the structure could not be erected thereby creating hardship upon the petitioner. It
was further determined that the proposed garage would be of no detriment to the neigh-
borhood or the community at large. It was an allowed use in an R-4 district and was
thereby no contrary to the North Andover Zoning By-Laws.
Upon motion of Mr. Noble, seconded by Mr. DiFruscio, the Board voted unanimously to
GRANT the variance.
