1. Thomas P. Ventura is an individual residing at
455 Main Street, North Andover, Massachusetts 01845,
Essex County, Massachusetts.
2 This is an appeal brought pursuant to G.L.
c. 4W- S17 .
3. Ventura is the owner of property on Turnpike
Street in the Town of North Andover, Massachusetts.
4. Frank Seiro, Jr. resides at 250 Hillside Road,
North Andover, Massachusetts .
5. Raymond Vivencio resides at 11 Apple Door
Street, North Andover, Massachusetts.
6 . Anna O'Connor resides at Martin Avenue, North
Andover, Massachusetts.

collectively are members of the Zoning Board of Appeals
of the Town of North Andover.
9 . Charles Grieco is an individual residing at 7
New Meadow Road, Lynnfield, Massachusetts.
10 . Grieco is the owner of property on Turnpike
Street, North Andover, Massachusetts known as 1650
Turnpike Street, which property immediately abuts the
Ventura property.
11. Located on the property known as 1650 Turnpike
Street is a commercial building.
12 . The commercial building is set back five feet
from the property line which divides 1650 Turnpike
Street from the Ventura property.
13. The required set back for the building is
either 50 or 100 feet under alternative interpretations
of the Town of North Andover Zoning By-law.
14 . Grieco made application to the Zoning Board of
Appeals of the Town of North Andover for a variance from
the set-back requirement.
15. In a decision of July 23, 1991, the variance
was granted.
16 . The grant of the variance will have an adverse
effect on the Ventura property by placing a large

commercial building so close to the property line that
the development potential for the Ventura property would
thereby be limited.
17 . The decision of the Zoning Board of Appeals
does not contain any of the detailed findings required
by G.L. c. 40, 510.
18. There is no basis in fact or in law for the
Zoning Board of Appeals granting the variance from the
set-+back requirement.
19 . The decision of the Zoning Board of Appeals
granting the variance from the set-back requirement is
unreasonable, arbitrary, capricious and otherwise

unlawful and in granting the variance from the set-back
requirement the Zoning Board of Appeals exceeded its
authority.

Lynnfield, MA 01940 DECISION _r
The Board of Appeals held a public hearing on Tuesday evening June 11 L
and July 9, 1991 upon the application of Charles Grieco as a petitioner
for a variation from the requirements of Sec. 7, Para. 7.3 and Table 2
so as to permit dimensional setbacks that are existing to remain at the
north side of Turnpike Street and known as 1650 (Lot #2A) Turnpike Street.
The following members were present and voting: Frank Serio, Jr. , Chairman,
Raymond Vivenzio, Anna O'Connor and Robert Ford.
The hearing was advertised in the North Andover Citizen on May 22 and 29,
1991 and all abutters were notified by regular mail.
After consideration of the issues, it was determined that the requirement
from which a variance is sought was 50' , not 100' as stated in the petition.
The variance sought is for a building which has been in existence for
several years, although the records of the erection of the building cannot
be located. The building is and has been occupied. The applicant is the
prospective purchaser at a mortgage foreclosure sale, who cannot extricate,
himself from the purchase agreement due to the zoning violation. - -
The current owner, who also owns the adjoining parcel, and the applicant r
have not been able to reach an agreement on a land purchase to cure the
violation, despite their best efforts. The current owner is the person
who developed the lot and built the offending building in question. No -"

documents pertaining to the erection of the building were proffered by
anyone, but the current owner states that he remembers seeing the Occupancy
Permit.
The Board felt that there was an extreme hardship being suffered by the
applicant in the event the variance was not granted, and a valuable building
would remain unproductive and constitute economic waste if the variance were
not allowed. The Board also felt that there would be no detriment to the
public good in this case, and no substantial derogation from the intent of
the bylaw if the variance were granted. The adjoining land is as yet undev-
eloped, and any other decision could lead to the forced removal of the

structure. One resident testified that the soil condition at the locus
compelled the present location of the building, as the remaining portions
of the lot were unstable.
Upon motion made by Ms. O'Connor to GRANT the variance as requested for
the above reasons, seconded by Mr. vivenzio, and the vote was unanimous
in favor thereof.

The Board of Appeals held a public hearing on Tuesday evening June 11
and July 9, 1991 upon the application of Charles Grieco as a petitioner
for a variation from the requirements of Sec. 7, Para. 7.3 and Table 2
so as to permit dimensional setbacks that are existing to remain at the
north side of Turnpike Street and known as 1650 (Lot #2A) Turnpike Street.
The following members were present and voting: Frank Serio, Jr. , Chairman,
Raymond Viven4io, Anna O'Connor and Robert Ford.
The hearing was advertised in the North Andover Citizen on May 22 and 29,
1991 and all abutters were notified by regular mail.
After consideration of the issues, it was determined that the requirement
from which a Variance is sought was 50' , not 100' as stated in the petition.
The variance $ought is for a building which has been in existence for
several years$ although the records of the erection of the building cannot
be located. The building is and has been occupied. The applicant is the
prospective purchaser at a mortgage foreclosure sale, who cannot extricate
himself from the purchase agreement due to the zoning violation.
The current owner, who also own the adjoining parcel, and the applicant
have not been able to reach an agreement on a land purchase to cure the
violation, despite their best efforts. The current owner is the person
who developed the lot and builtllthe offending building in question. No
documents pertaining to the erection of the building were proffered by
anyone, but the current owner spates that he remembers seeing the Occupancy
Permit.
The Board felt that there was extreme hardship being suffered by the
applicant in the event the vari nce was not granted, and a valuable building
would remain unproductive and c nstitute economic waste if the variance were
not allowed. The Board also fe t that there would be no detriment to the
public good in this case, and n substantial derogation from the intent of
the bylaw if the variance were ranted. The adjoining land is as yet undev-
eloped, and any other decision could lead to the forced removal of the

structure. One resident testified that the soil condition at the locus
compelled the present location of the building, as the remaining portions
of the lot were unstable.
Upon motion made by Ms. O'Connor to GRANT the variance as requested for
the above reasons, seconded by Mr. vivenzio, and the vote was unanimous
in favor thereof.
