Dear Sir:, ' After a duly advertised Public Hearing held on Monday, October 6, 1958 at 8.:00 PM at the Town Building, the Planning Board of North Andover heard the petition of J. Elaine Griffin, 841 Chickering Road requesting the rezoning of land from Rural Residence to Country Residence. The land is located 330 feet Easterly on Osgood Street, 321 feet Southerly on Prescott Street and 335.3 feet Westerly on Chickering Road and is known as 841 Chickering Road, TI-is is to advise the Planning Board has taken no action on this matter. This Cause came on to be heard at a meeting of the Board on Monday., December 8, 1958 at 7:30 PM. Members present were Daniel T. O 'Leary, Chairman, Kenneth Terroux, Secretary, Robert Burke and Henry, Lund. William Morton, Associate Member, was designated to sit in place of Donald F. Smith, regular member, who was absent. The petitioner was represented by Atty. Arnold Salisbury. The petitioner applied for a special permit under the provisions of Section 6.2 of the Zoning By Law so as to permit the subdivision of the premises located on the East side of Chickering Road to the Southwest of Osgood Street and the North of Prescott Street, in accordance with the plans filed by the petitioner entitled Plan of Land of J. Elaine Griffin, North Andover, Mass ., Ralph Brasseur C.E. November 1958. The Board finds that the proposed subdivision of the property would result in two lots, one of 30,016 square feet more or less and the other of 36.716 square feet more or less. An application for a Variance had previously been brought by the petitioner for the same purpose and was denied by the Board. The Board finds that the promises are located in an area zoned Rural Residence. The Board further finds that 'after the ,proposed subdivision, neither lot would contain the required area as set forth in the Zoning By Law for Rural Residence district. Upon motion duly made and seconded it was unanimously voted by thos members present, Kenneth Terroux, who was present at the hearing, was absent and did not vote when the vote was taken, that the petition be denied. REASONS FOR DECISION. The Board is of the opinion that the present application does not fall with purview of a special permit but is rather an application for a variance which has previously been denied. I Although the petitioner may in fact be under a hardship, the Board feels to grant relief such as applied for would in effect be an amendment to the By Law and would be contrary to the intent and purpose of the present zoning By Law. Present and voting were Daniel O'Leary,, Chairman, .Kenneth lerroua, Hobert Burke , Donald Smith and Alfred boeglin, Associate Member. The Fetitioner appeared for herself and no one appeared in opposition to the petition. The board was advised and finds that the lot in question is a triang- ular piece of land bounded on the Northeast by Osgood Street, on the west by Chickering noad and on the South by Prescott Street. The lot is _located in a aural Residence district and there is now located on the Northerly portion of the lot a single family dwelling owned by the Petitioner. the only evidence was that the lot in question was too large to be mainta_ned by the Petitioner, and that it was a hardship and a burden on the Petitioner financially and that the Fetitioner de- sired to sub-divide into two lots so that the Southerly portion thereof, as shown on the plan of land ofJ. Maine Griffin, Worth Andover, July 1958) nalph Brasseur, CB, filed with the board and made a part of this decision and the Petitioner further reported to the .Board that she desix4d to sell to relieve the financial burden. The :Board heard no evidence that this lot which the Fetitioner sought to divide in any way differed from any other lot in the same Zoning district. Upon motion duly made and seconded, it was unanimously voted that the petition for a variance be denied. Reasons for decision, although the Board :finds that no doubt maintenance of the premises in question in- volves a' hardship on the Petitioner, the Board cannot find there are any conditions especially affecting these premises which do not general- ly, affect other premises in the same Zoning district; that the denial of the variance would, no doubt, be a hardship on her but that the hardship is a pecuniary one only, and that relief cannot be granted in 4 this case without substantially derogating from the intent of the By-Law. 44ania, 011earyi airman Kenneth Terrouz Robert Burke Donald Smith Alfred BoeglinxAssoc.
