Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening ,
September 19 , 1983 upon the application of Leonard Gus tus . The
hearing was advertised in the North Andover Citizen on August 25
and September 1 , 1983 and all abutters were notified by mail .
The following members were present and voting : Frank Serio , Jr . ,
Chairman ; Alfred E. Frizelle ,, Esq. , Vice Chairman; Richard J .
Trepanier , Esq . , Clerk ; and Associate Members Walter F . Soule
and Maurice S . Foulds .
The petitioner seeks a variance from the provisions of Section 6 ,
Paragraph 6 .. 5 of the Zoning By Law sous to permit the erection
of a lighted sign on premises located at 1705 Turnpike Street .
The petitioner testified that he is seeking a variance to erect
a lighted sign for his business known as "The Farmer' s Market" .
Because there is an existing sign on the premises for another
business establishment, the variance is necessary .
He further testified that the ,sign is necessary for recognition
since his store is not easily seen from the road .
The Board voted unanimously to take the petition under advisement .
On October 17, 1983 the Board rendered its decision , with Members

Upon a motion made by Mr. Foulds and seconded by Mr . Frizelle ,
the Board voted unanimously to grant the variance , subject to
the condition that the sign be limited to 3 ' x 5 ' and that it
be lit from within in line with the light poles and on his own
property and not to extend over the property line .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . Specifically , the Board finds that a literal enforce-
ment of the Zoning By Law would create a hardship to the petitioner.
Said variance may be granted without substantial detriment to the
public good and without nullifying or substantially derogating
from,- the intent and purpose of the Zoning By Law.
