Dear Mr. Long:
A public hearing was held by the Board of Appeals on May 8, 1978 upon application
of Haffner Realty Trust who requested a variation of Sec. 6.3 and Table 2 of the
Zoning By—Law so as to permit the construction of a canopy over gasoline pump
islands as shown on a plan dated October 18, 1977 on the premises located at the
west side of Chickering Rd. and known as 564 Chickering Rd. The following members
were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice—
Chairman; Louis DiFruscio, Clerk; James D. Noble, Jr.; and Assoc. Member Richard
J. Trepanier.
The hearing was advertised in the Lawrence Eagle Tribune on April 22 & 29, 1978
and all abutters were duly notified by regular mail.
The petitioner, represented by Atty. James F. Waldron, has petitioned the Board
seeking a variance from the provisions of Sec. 6.3 and table 2 of the By—Law to
enable the construction of a canopy over the gasoline pump islands on premises
located on Chickering Rd.
The petitioner presented evidence showing that the unusual shape of the parcel of
land created a hardship in that it prevented the petitioner from constructing a
canopy in any other fashion. The petitioner also showed that the design and con—
struction of the canopywill not derogate from the intent or purpose of the By-Law

nor derogate from the zoning district.
Upon motion made by Mr. Frizelle and seconded by Mr. DiFruscio the Board unanimously
voted to GRANT the variance for a canopy to be constructed 14 ft. from the lot line
with the following conditions:
1) that all lights shall be placed underneath the canopy directed downward;
2) that a non—lighted sign is allowed on the outside of the canopy provided
that such sign meets the requirements of the North Andover Sign By—Law;

3) the construction shall conform to the drawing "Proposed Canopies, Chickering Rd.,
No. Andover, Ma., owner: 'Haffner Service Stations, Inc." dated 10-28-77, revised
4-12 & 4-18-78;
4) construction shall be completed by Dec. 31, 1978 otherwise this variance shall be
null and void;
5) that the animated standing sign closest to Rte. 125 shall be eliminated;
6) a complete plan of the canopy must be submitted to the Board for approval prior to the
issuance of a building permit;
7) no signs shall be allowed''on top of the roof of the canopy.
The Board found that the petition met the requirements as set forth in Sec. 9.5 of the
By-Law.
