Lyons, Town C erk Town Building North Andover, Mass. , Bear :its The following petition was heard at a meeting of the Board of .appeals on Monday evening, March 14, 1966 at the Town Office Building. Members present and voting were; Daniel T. OtLeary, Chairman; William Morton, Secretary; Arthur Drummond., James Deyo and Associate Member Howard Gilman, who sat in place of John J. Shields. IBRAHIM EL-HEFNI requested a variation of See. 6.33 of the Zoning By-Law so as to permit the division of an existing lot into two lots, having more than the required frontage but less than the required area, on the premises located at the north side of Great pond Road; 4000 feet distant from the corner of Osgood Street and known as Lot #25• This public hearing was 'advertised in the Eagle-Tribune on February 28 and March 7, 1966. All abutters were duly notified by certified mail of this hearing. Atty. ' Harold Morley represented the petitioner, who was also present. He explained that the lots have more than enough frontage and that one of the lots is an unusually. shaped lot. He was unable to purchase additional land from abutters in order to meet area requirements. Mr. El-Hefni will fence off the area with a 4-5 foot chain link fence, which will solve a current problem for the Town since there is an Article in the Special Town Meeting for the Town to construct a fence because of parking problems in the area. In Executive session, after thorough discussion, Mr. Morton Made a motion to GRANT the verianoe and Mr. Dsnmenond seconded the motion. Four members voted In favor of granting the variance. Mr. Deyo abstained from voting. The Board voted to grant the variancf for the following reasons: f a. The proposed lots would not be in derogation to the neighborhood, b. There exist certain conditions especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. c. The Board sees no derogation to abutting properties or to existing neighborhood influences. ' d. To deny the said petition would result in a substantial hardship, fimmci.al or pithervise.
