Every application for action by the Board shall be made on

shall be treated as mere notice of intention to seek relief until such

Dear Sir:
Upon application of Joseph A. & Esther C. Ippolito to the North Andover Board of
Appeals for a variance Linder Section 6.32 of the North Andover Zoning By-Laws
so as to permit the division of four existing lots into two lots which would
not have the required street frontage of 125 feet nor the required area of
25,000 square feet, a public hearing was held on November 18, 1968 by the North
Andover Board of Appeals. The hearing was held in the Town Hall facilities
after having been advertised in the Lawrence Eagle Tribune on the dates
November 2 and 9, 1968 and with all abutters duly notified by certified mail.
The members of the Board present and voting were: James A. Deyo, Chairman;
Arthur Drummond, Secretary; Daniel T. O'Leary, Donald J. Scott and J. Philip
Arsenault, Esq.
The petitioner was represented by Atty. Thaddeus Falys, who pleaded the petition
by stating the desired division was in keeping with other lots in the immediate
area. The two lots created would be approximately the size required for Village
residentially zoned land which abuts the land in question to the immediate north.
Most of the lots on the street have about the same area as those sought and
several are smaller. To deny the variance sought would impose hardships, financial
or otherwise on the petitioner.
There were objections heard to the petition, particularly from abutters whose lots
exceeded the minimum requirement. These arguments concerned themselves both with
the small size of the lot and with the lack of frontage required.
On motion approved the petition was taken under advisement. During subsequent
discussion there remained unresolved a question as to a paper street adjacent to
one of the lots. After resolving this problem the petition was voted favorably
on a motion by Mr. O'Leary, seconded by Mr. Scott and voted unanimously.

The principal reasons for granting this variance under Section 6.32 of the
Zoning By—Laws so as to create two lots from four as indicated by the accompanying
plans are as follows along with a special condition.
1. Granting the variance would not deviate from the intent and purpose of the
Zoning By—Laws.
2. Denial of the petition would cause hardship, financial or otherwise to the
petitioner.
3. The lots created are in keeping and not significantly different from those
in the irmediate area, and on the same street.
Special condition is as follows:
This variance is granted subject to the condition that such title as the
petitioner may have in and to any part of the private way abutting on the east
side of the east lot, ]mown as Lot B, shall not be conveyed except as part of,
or in conjunction with, any conveyance of Lot B.
