Dear Mr. Long:
The North Andover Planning Board held a public hearing on
Thursday evening, August 18 , 1988 in the Town Hall, Selectmen' s
Meeting Room upon the application of J.N. Phillips Glass Co. , inc. ,
Philip Rosenfield, 345 North Avenue, Wakefield, MA. The hearing
was duly advertised in the North Andover Citizen on July 28 and
August 4, 1988 . The following members were present: George Perna,
Vice-Chairman; John Simons, Clerk; Erich Nitzsche and Michael Leary.
Chairman, Paul Hedstrom arrived at 8: 40 p.m.
John Simons read the legal notice to open the public hearing.
The petitioner seeks approval for Site Plan Review under
Section 8 . 3 of the Zoning Bylaw to utilize an existing structure
located at 150 Sutton Street for a glass repair facility. The
existing structure contains approximately 2,600 sq.ft. on a lot
that contains approximately 6,082 sq.ft. in a Residential-4
Zoning District.
Attorney Victor Hatem was present representing the applicant.
Attorney Hatem gave a brief scenario of the proposed. The Board of
Appeals has granted the petitioner the change of use to an auto
glass repair facility. The billboard on the property will be removed
upon the expiration of the present lease.
The Planning Board expressed concerns about parking, movement
of vehicles in the parking lot and the sign. One parking space will
be removed. The Board requested the sign be made of wood and not
illuminated.
The Fire Department had concerns of safety and access of the
fire trucks . Those concerns will be addressed in the decision.
Erich Nitzsche made a motion to close the public hearing and
take the matter under advisement. The motion was seconded by
Paul Hedstrom and voted unanimously by the Board.
Due to the lack of a quorum on September 8, 1988, the Planning
Board did not meet. The meeting was rescheduled for September 13, 1988.

On September 13, 1988 the North Andover Planning Board held
a meeting with the following members present and voting:
Paul Hedstrom, Chairman; George Perna, Vice-Chairman; John Simons,
Clerk; Erich Nitzsche and Michael Leary.
Following a brief discussion on the proposed sign, the Board
amemded the draft decision.
John Simons made a motion to approve the Site Plan subject
to the amendments of the wood sign. The motion was seconded by
Erich Nitzsche and voted unanimously by the Board.

The Plamninq Board makes the following findings regarding this
applicat�on for a �oecial Permit as required under Section 10 .31 of the
� Zonin;4 Bylaw:
A . The site is an appropriate location for such a use,
�truct�r�_ ur condition;
B . The use developed and conditioned in this decision will not
adversely affect the surrounding neighborhood ;
C. There viiibe no nuisance or serious hazard to vehicles or
pedestr� ane ;
D. Adequc3te and appropriate facilities will be provided for the
Prober operation of the proposed use;
E. The Special Permit application before us is in harmony with the
qeneral pur�ose and intent of this Bylaw.
The Planning Board makes the findings as required under Section 8.35
that tne site Dlar generally complies with Town Bylaw requirements but
still requires conditions to fully comply with the purposes
and intent of the _oning Bylaw. Therefore, in order to fully comply
with the approvals n�cessary to construct the facility as specified in
this special pe, m , t before us, the Planning Board hereby grants a
special oermit to the applicant provided the following conditions are
met :
I . Conditions to be met prior to the plans be endorsed by the Board
and with the Registry of Deeds Office:
1 . Landscaping plan shall be submitted which shows the
folloulnl :
a . One tree for every 30 linear feet of frontage of the
lot along Sutton Street shall be planted within the
sid��alk .

west 1f the building to protect landscaping materials and

The Planning Board males the following findings regarding this
application for a Special Permit as required under Section 10.81 of the
Zoning Bylaw:
A . The specific site is an appropriate Location for such a use,
structure, or condition;
B. The use as developed and conditioned in this decision will not
adversely affect the surrounding neighborhood ;
C. There will be no nuisance or serious hazard to vehicles or-
pedestrians ;
D. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use ;
E. The Special Permit application before us is in harmony with .the
general purpose and intent of this Bylaw.
The Planning Board makes the findings as required under- Section 8. 35

maintained along the entire rear property line excspt where
the building is located and alnng the Side yard line
adjacent to the 8" concrete retaining wall .
4 . Wheel stops shall be placed in the 4 pa,-king spaces located
west of the building to protect landscaping materials and
the wood fences.

order to provide for emergency access and maintain
sightlines to enter and exit this site.
