Dear Sir:
Upon application of John A. James, Administrator of the Grace E. James Estate
requesting a variance under Sections 6.31 and 7.23 of the Horth Andover Zoning
By6laws so as to permit the subdivision of a vacant lot into two parcels, a
public hearing was held on July S, 1968 by the Horth Andover Board of Appeals.
The hearing was held in the Town Hall facilities after having been advertised in
the Lawrence Eagle-Tribune on the dates June 22 and June 29, 1%8 and with all
abutters du3y notified by certified mail. The members of the Board present and
voting were; James A. Deyo, Chairman; Arthur Drummond, Secretary; Daniel T.
O'Leary, Donald J. Scott and John J. Shields.
Atty. Frederick Murdock represented the petitioner John A. James, Administrator of
the estate of Grace 1;. James and pleaded that he was acting to fulfill a moral
obligation. The vacant lot was to be divided into two parts with each part to be
conveyed to the adjacent property owners. The effect would be to increase the size
of the adjacent lots.
There were several abutters present, all of whom spoke favorably of the petition. L
The petition was taken under advisement. During this period on a motion by Mr,
O'Leary,, seconded by Mr. Shields, the petition was approved unanimously.
The principal reasons for granting the petition are as followas
1. Granting the petition will not deviate from the intent and purpose of the
zoning by-laws.
2. There will be no changes as a result of this approval that would be apparent
to the casual. passer-by.
3. Lot aC-1" will run with Lot "B" and Lot "C.2" will run with Lot rVI thus
making each lot larger and more inconformity with the requirements of-the
Zoning BY-Lows.
