The North Andover Planning Board has disapproved the Preliminary
Plans for Jerad Phase III for the following reasons:
1. The length of the deadend roadway exceeds the maximum length
allowed by the Subdivision Rules and Regulations. Sec. IIB,
Para. 8a.
a. A waiver request for the 1500 ft. roadway with
cul-de-sac is requested. Please itemize reasons
for waiver in request.
b. No provision has been made or shown for the
continuation or access to, or proper projection of
potential streets as provided for in Sec. IIB, Para. 5.
C. Compliance to Sec IV, Para lE should be shown.
2. The roadway would require extensive filling to access uplands.
The NACC would recommend that the applicant attempt to gain
access from Boxford street or from another location within
Jerad Place I.
3. There is concern as to whether Lots 1 , 11 , 12 and 14 will
meet the minimum 75% continguous upland requirements.
4 . There are no accommodations made for temporary. silta.-tion
ponds on the site to accommodate erosion problems during
construction.
5 . The design of the detention pond, runoffs and the possible
impact to adjacent lands within the subdivision and also
with the abutters is not clear. Compliance to Sec. IV,
Para. E should be shown.
a. Clarifications of abutters low land and possible wet
land should be shown/taken into account.
b. There are no proposals for permanent detention ponds
on the site. The applicant has proposed exiting the
site drainage into the existing resource area. This
is inconsistent with the policy of the NACC.
6. Easement through lot 5 which is part of proposed R.O.W.
to Jerad Place III needs clarification. This development
renders lot 5 unbuildable - a note should be made on the
plans.
7 . Contiguous buildable area should be shown for each lot.
8. The locus map should show the proposed street in the subdivision
(scale 1" to 6000 not 1" to 1000)
9 There is not key for the utilities shown.
10 . The New England Power Company easement should be clearly
shown.

11. No Soil tests have been conducted as of May 28. It looks
like any septic system for Lots 1 and 11 will have trouble
meeting the hundred foot wetland offset required by the
Board of Health.
12 .'' The roadway shall cross the wetlands at the shortest possible
point, not as shown.
13 . The proposed road is not named per Rules and Regulations,
Sec_ II, B6 and Sec. III, 2a6.
14. The applicant shall be advised that in the event a Definitive
Plan evolves from this Preliminary Plan and/or parcel of land,
The North Andover Planning Board will require upon submittal
that all aspects of the Rules and Regulations governing the
Subdivision of Land must be strictly adhered to and will
be a requirement notwithstanding this decision, along
with the following conditions should be addressed:
a. A request for determination has to be filed with the
North Andover Conservation Commission per Section 310
CMR, 10.57 (4) (b) under Chapter 131 — Wetlands
Protection Act, and the local wetlands bylaws and the
plans have not delineated the edge of the< bordening
vegetated wetlands. The plan does not show the extent
of the wetlands on thn-adjacent parcel which may be
affected.
b. The Fire Chief' s recommendations should be taken into
account as follows:
1 . Fire hydrants to be installed at 500 ' intervals.
2. Lot numbers to be posted during construction.
3. No open burning is to be permitted except during
open burning season under fire department
regulations.
4 . All builders must be in compliance with the fire
r.. departments underground fuel storage regulations
and no permits will be issued on lots found
r unsuitable by the= North Andover Conservation
Commission.
c 5. Permanent house numbers shall be posted on
dwellings prior to occupancy.

6. Prior to taking occupancy, the subdivision
streets shall provide adequate access to each
d residence by having had the binder coat applied.
7 . As a matter of public safety, I strongly recommend
the installation of a residential sprinkler in
each proposed dwelling in accordance with
NFPA 13D and North Andover Fire Department
requirements.
8. Any dwelling over 500 ' from the subdivision
street measured along the driveway shall be
required to have an additional fire hydrant and
a residential sprinkler system installed.

9. A street sign approved by the Division of Public
Works is to be posted at the intersection of
the proposed road and Candlestick Road.
C. No lots shall be released from the covenant running
with the property until the following is completed.
All drainage is constructed in accordance with the
Subdivision Plan, including binder coat application,
all utilities, including but not limited to fire
alarms, water lines, sewer, drainage, electric, gas,
cable shall be installed in accordance with the plans.
d. Drainage calculations will have to be submitted to
mitigate runoff. No calculations or drainage plan
has yet been submitted to prove the Planning
Board that the subdivision can mitigate increased
runoff without affecting abutting propoerty.
e. The Highway Surveyor' s recommendations shall be
addressed as follows:
1 . Catch basins to be 8 precast concrete with 8"
Barrell blocks used for pipe courses only.
2. Any brick to be clay brick and all mortar to
be portland cement mortar.
3. All shoulder areas to be 8 ' with a 1/4" per
foot rise from pavement.
r�- 4. Cul-de-sac as shown not acceptable.
5. No service will be provided by this department until
' binder is in place and the road is free of excavations
' and any other obstacles that would hamper service
vehicles.
r uf. A detailed tree plan in accordance with Section V, K
car and IV.l will have to be submitted with the plan for
.i review by the Planning Board and the Tree Warden. The
applicant will have to address the Tree Departments
recommendations to preserve existing trees and to bond
for new planting if appropriate.
g. A stump pit burial plan will have to be submitted to
the Planning Board and Highway Department for review and
approval prior to any on-site construction.
h. There shall be no common driveways within this
subdivision.
i. The Police Department recommendations should be
as follows:
1 . A stop sign and a stop line may be required at
the intersention of the proposed road and
Candlestick Road.

Dear Mr . Long :
The North Andover Planning Board held a public hearing on
Thursday evening , December 3, 1987, upon the application of Robert
Janusz , 40 Sunset Rock Road, Andover , MA. The hearing was advertised in
the North Andover Citizen on November 12 and November 19, 1987, The
following members were present and voting : Paul Hedstrom, Chairman;
George Perna, Vice-Chairman; John Simons, Clerk ; and John Burke.
The petitioner seeks three Special Permits for common driveways
under SEction 2.30 . 1 of the North Andover Zoning Bylaws. The purpose of
the three special permits is for the construction and use of individual
driveways to gain access to Lots 36 and 37, Lots 113 and 19, Lots 25 and
27, all on the North side of Candlestick Road . Each lot consists of an
area of 43,560 square feet more or less and with frontage of 150 feet .
John Simons read the three legal notices to open the public
hearings. Tom Neve, Thomas E. Neve Assoicates, was present and
represented the applicant. Mr. Neve stated that changes were made on
the plans to comply with the decision of Jerad II and because of the
geometry of the land , and to minimize wetland crossings the common
driveways were being proposed.
A motion was made by John Burke to take the matter under
advisement and close the public hearing, seconded by George Perna and
voted unanimously of those present .
On February 25, 1988 the North Andover Planning Board held a
meeting with the following members present and voting : Paul Hedstrom,
Chairman; George Perna, Vice-Chairman; John Simons, Clerk ; and Erich
Nitzsche. On a motion by Erich Nitzsche to approve the three (3) common
driveways subject to eleven ( 11 ) conditions, seconded by John Simons ,
the Board voted unanimously of those present .

Three Special Permits - Common Driveways
Jerad II Definitive Subdivision
( 1 ) Lots 36 & 37, (2) Lots 25 & 27, (3) Lot 18 & 19.
The Planning Board makes the following findings regarding the
three ( 3) Special Permit Applications cited above:
1 . The application adheres to the bylaw restriction that
not more than three (3) lots be served by a common
driveway.
2. The specific location of the common driveways are
appropriate due to existing steep topography found on
each lot involved .
3. Their design and location will not adversely affect
the surrounding properties.
4. Adequate standards have been placed on their design
which will meet public health and safety concerns.
5. The purpose and intent of the regulations contained in
the Zoning Bylaw are met with the Special Permit
Applications before us.
The Planning Board votes to conditionally approve the Special
Permits with the following conditions:
1 . Easements pertaining to the rights of access for
driveways between the lots involved shall be filed
with the Registry of Deeds Office prior to the
issuance of the Building Permit for any lot served by
a common driveway .
2. No occupancy permit shall be issued to any structure
accessed by a common driveway until the standards
included in this decision are met by the applicant .
3. The driveways shall not exceed a grade of 8%.
4. Backout areas shall be provided at the termius of the
driveway adjacent to the structure.
5. The driveway pavement section shall be a minimum of
12 ' wide and shall not exceed a 20 ' wide pavement
section.

6. The side slopes of the crossing shall be constructed
at a ratio of 1 :2 ( 1 horizontal to 2 vertical ) with
not less than six (b) inch rip-rap for slope
stablization or the sides of the crossing shall be
vertical walls constructed of eighteen to twenty-four
( 18-24) inch stone. All eastern slopes associated
with the crossing shall be stablized with perennial
grass.
7. A permanent stone marker 8"x8" and 4 ' high above grade
shall be placed at the entrance of the driveway where
it intersects with the road . The marker shall not be
obstructed by planting or structures. The marker
shall be engraved to a depth of 1 " and be 2" in height
and be placed at the top of the marker in ascending
numerical sequence. The engraved numbers shall be
overlaid with a flat black oil base paint .
S. All residential buildings served by a common driveway
shall be equipped with residential sprinkler systems
in accordance with NFPA 13D and the North Andover Fire
Department Requirements.
9. All structures shall clearly post the street number on
the building with number (s ) 3" high clearly visible
from the driveway.
10. No more than two (2) separate structures on separate
lots of record shall be accessed by a common driveway.
11 . A shared maintenance agreement for the driveway shall
be placed on the deeds of the lots utilizing the
common driveway. Said agreement shall utilize
language sufficient to insure that the driveway shall
be perpetually maintained by the owners of the lots
involved with no liability to the Town of North
Andover . The language shall be submitted to the
Planning Board for review and placed on the deed of
subdivision upon filing the subdivision plan , or upon
deeds of the individual lots serviced by a common
driveway with the Registry of Deeds Office.
