Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening,
August 8 , 1983 upon the application of Jayson Realty, Inc . The
hearing was advertised in the North Andover Citizen on July 21
and 28, 1983 and all abutters were notified by regular mail .
The following members were present and voting : Frank Serio , Jr . ,
Chairman ; Alfred E. Fri zel1e , Esq ., Vice Chairman ; Richard J .
Trepanier, Esq . , Clerk ; William J . Sullivan ; and Augustine W .
Nickerson .
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7 . 3 and Table 2 of the Zoning By Law so as to permit
relief from the front setback requirement to allow the continued
existence of a dwelling having less than the required front set-
back on premises located on the North side of Cotuit Street and
known as 81-83 Cotuit Street.
The petitioner testified through counsel that the dwelling in
question is a new condominium. Through an engineering error , the
dwelling was placed 2.2 feet too close to the street,. The viola -
tion was discovered when a plot plan wa-s required .
Building Inspector Charles Foster testified that the violation was
discovered some time ago , and the builder proceeded to complete the
house knowing the infringement existed ,
A motion was made by Mr. Trepanier and seconded by Mr. Frizelle to
grant the variance as requested. The motion failed to carry, with
members Serio; Frizelle , and Trepanier voting in favor and members
Sullivan and Nickerson voting in opposition .

Pursuant to MGL , Chapter 40A and the Zoning By Law of the town
of North Andover, Section 10 , Paragraph 10.4 (2) , the variance
is denied.
In denying the petition , the Board finds that Section 10.4 of
the Zoning By Law has not been satisfied. Specifically , the
Board finds that the evidence presented by the petitioner failed
to show a hardship as required by Section 10 .4 of the Zoning By
Law .

Dear Mr. Long
The Board of, A�peals held a public hearing on Monday evening,
May 9, 1983 upon the application of Jayson Realty, Inc. The
hearing was advertised in the North Andover Citizen on April 21
and 28, 1983 and all abutters were notified by regular mail.
The following members were present and voting: Frank Serio,
Jr. , Chairman;lAlfred E. Frizelle, Esq. , Vice Chairman; Richard
J. Trepanier, Esq. , Clerk; William J. Sullivan; and Augustine W.
Nickerson.
The petitioner, seeks a variance from the provisions of Section 7,
Paragraphs 7. 7 and 7 . 2 and Table 2 of the Zoning By Law so as to
permit a change in a lot created by. variance to. keep the same area
and provide additional frontage on . Halifax Street on premises lo-
cated at the West side of Halifax Street.
The petitioner testified that the land in question was divided by
variance several years ago with one lot on Margate Road and one
on Halifax Street. The petitioner now wishes to "swap" land with
an abutter (Lots A-1 and B-1 as shown on the plan) and such a
transaction requires a re-submittal to the Board of Appeals.
According to the petitioner, Lot A-1 will remain 11,000 square
feet and Lot B-1 will now contain additional frontage.
Upon a motionimade by Mr. Frizelle and seconded by Mr. Trepanier,
the Board voted unanimously to grant the variance ,as requested.
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied, in addition, the Board finds that the relief can be
granted without derogating from the intent and purpose of the
Zoning By Law and without creating a detriment to the neighborhood.
