HomeMy WebLinkAbout1958-03-10Regular Meeting The regular monthly meeting of the Board of Appeals was held on March 10, 1958 at 7:3© PM in the Town Building. Members present and voting were: Donal~ F. Smith, Chairman, Nicholas F. Nicetta, Henry E. Lund, Daniel O'Leary, Alfred Boegltn Associate Member and Benedict Perrone, Associate Member. An executive session was held before any business was referred to. Due to Mrs. Donahue not being able to continue in the position of Clerk for the Board, it was unanimously agreed to employ Mrs. Doherty as future Clerk. Mr. Smith expressed to the members the number of telephone calls he has been receiving regarding various questions on building permits, etc. It was decided by the Board that, henceforth, anyone wanting building permits should go to the Building Inspector. The Board shall make no decisions for any other Board of the Town until such time it is properly brought before the Board of Appeals. Mr. Perrone moved that this matter be taken up with the Board of Selectmen in the form of a letter to be written by Mr. Smith. Mr. Perrone sat in place of Mr. Lurid who was unable to Stay for the hearings and Mr. Boegltn sat in place of Mr. Terroux. First Hearing. Andover Realty Company petitioned for a variance of the requirements of 6.3 of the Zoning By Law so as to allow the erection of a single family dwelling on the premises located on the Northeast side of Main Street, 84.7 feet from the corner of 6"nicker- ing Road. Mrs. John Cushing spoke stating she did not object to a dwelling being erected but she did not want drainage from that lot graded to her land. Mr~ S~mmers, representing the Andover Realty Company, stated a clause could be put in the deed stating the property must be properly graded and drained. The motion to take the matter under advisement was made by Mr. Nicetta and seconded by Mr. O'Leary. Unanimous vote. Second Hearing. Attorney Cinvent OUrcio represented Miss Jane Wysocki for a variance of Section 5.1 of the Zoning By Law' so as to permit the rem~al of Sand and gravel on land located on the Southerly side of 876 Forest Street. Attorney McNiff represented adjacent abutters of the *w=a-diate and pointed out if the permit were granted it would mean heavy trucks passing on Salem and Forest Streets which are narrow roads not in very good condition and that there are quite a few children in neighborhood and this heavy traffic would be very dangerous andwould require policing. Mr. F~ank T~ombly, 4~ve~ of ~ s~ool bus in this. area pointed out that the roads are approximately ten feet wide and are too for the type of truck that would be needed for haulding sand a~d gravel. Mr. McNiff s~ated Mr. Gilboard, Selectman in Middleton, has told him that this sand and gravel pit would be unwelcome by the Town of Middleton as it is only .3 of a mil from the Middleton line. Mr. 0'Leafy asked how mu~h sand an gravel would be removed from the pit and Miss Wysock informed the Board 800,000 yards would be removed over a five year period. Mr. O'Leary then asked if this would be seasonable and received the answer that the work would be done nine months a year. Mr. Smith, asked where the gravel would be going and an exact answer could not be given but Mr. Curcio stated with all the building going on locally contractors are looking for a local supply. Mr. Smith then asked which routes the trucks would take and Mr. Curcio stated the contracts could specify the routes to be taken. Mr. Bohn- wagner of Inmes Street pointed out She conditions of Salem Street as he travels on this street every day. Mr. O'Leary moved to take the matter under advisement. Mr. Boeglin seconded the motion. Unanimous vote. Third Hearing. Application of Daniel~Oleni'o, 1591 Osgood Street for a permit~for a taxi stand. Mr. Olenio stated taxis come from Lawrence and Haverhill to service Western Electric personnel but none from North Andover. Bus service is only at 3:00 PM and 11:00 PM. Mr. Smith asked what kind of a building would be erected and Mr. OleniO informed the Board no building would be needed as the restaurant could be used for an office for the taxi business. Mr. Perrone asked how many taxis would be needed and was told only one cab would be used. Mr. Smith informed Mr. Olenio the matter Would be taken under advisement. The Board decided the Building Inspector would be in- formed that no variance ~ould be required regarding the Andover Realty petition Providing the zoning laws of 1943 are complied with, namely, 15 feet side and rear lines, 30 feet front yard requirements, Mr. Perrone so moved. Mr. O'Leary seconded the motion. Unanimous vote. The matter of Mr. Olenio was decided to be referred to the Board of Selectmen as a taxi license must be issued by the Selectmen. The Board feels a building permit should be issued inasmuch as no build- ing would be required. Unanimous vote. The Board decided to meet at ~:00 AM Sunday, March 16 to view the property of Miss Jane Wysocki. The meeting adjourned at 9:50 PM. Chairman Clerk
