Dear Sir: A public hearing was held by the Board of Appeals on November 13, 1978 upon applioa- tion of Francis H. Magoon who requested a variation of Sec. 6.3 and Table 2 of the Zoning By-Law so as to permit the construction of a two-car garage and breezeway as shown on a plan of land located at 51 Moody St. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice -Chairman; Fames D. Noble, Jr.; John J. Gaffny, III; and Assoc. Member Richard J. Trepanier. The hearing was advertised in the Lawrence Eagle-Tribune on Oct. 28 & Nov. 4, 1978 and all abutters were duly notified by regular mail. Mr. Magoon represented himself before the Board and stated that the existing dwelling is so looated that there is not room enough to erect and garage and breezeway on the lot without' a variance. The land adjacent is not a building lot and, therefore, would not derogate from the intent of the Zoning By-Law. Furber Ave. which abutts the locus has to be left open for a right of way for surface drains, etc. The placement of the house on the lot is a hardship in this petition. There was no opposition to the petition. Mr. Gaffny pude a motion to GRANT the variance allowing Mr. Magoon to build no closer than 6 ft. of the property line as shown on plan dated November, 1978 subject to the plan being amended to show the builds in the new location.
