Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening,
May 21 , 1984 upon the application of A. J. Maillett Construc-
tion. The hearing was advertised in the North Andover Citizen
on April 26 and May 3, 1984 and all abutters were notified by
regular mail . The following members were present and voting:
Frank Serio, Jr . , Chairman; Richard J. Trepanier, Esq. , Clerk;
William J. Sullivan; and Associate Members Maurice S. Foulds
and Raymond A. Vivenzio.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7 . 2 and Table 2 of the Zoning By Law so as to permit
relief from the minimum frontage requirements to allow the sub-
division of a lot into two lots on premises located on the East
side of Davis Street known as 57 Davis Street .
Mr . Thomas Neve, project engineer, testified that the lot in
question contains 32 ,600 square feet with 133 feet of frontage
on Davis Street, located in the Residential-4 (R-4) zoning
district, where 12,500 square feet with 100 feet of frontage
is required. There is an existing dwelling with a detached
garage on the lot. The proposal is to subdivide the lot into
two lots. Each lot will contain adequate area and the dwellings
will meet the setback requirements ,irements but would lack adequate
frontage. Also there is an addition to the garage on Lot 1

and a shed on Lot 2 which do not meet the setback requirements
and both structures will be removed. The petitioner proposes
to construct a two-family dwelling on Lot 2.
Several neighbors voiced opposition to the construction of a two-
family dwelling proposed for Lot 2.

Upon a motion made by Mr. Trepanier and seconded by Mr. Vivenzio,
; the Board voted unanimously to grant the variance subject to the
( following conditions:
1 . That only a single family dwelling be constructed on Lot 2 and
that the existing dwelling on Lot 1 remain a single family
dwelling.
� 2. That revised plans be submitted which meet the Board' s re-
quirements prior to the issuance of a building permit .
3. That the existing garage addition on Lot 1 and the existing
shed on Lot 2 be removed as shown on the plan prior to the
issuance of a building permit .
In granting the variance, the Board finds that Sectin 10.4 of the
Zoning By Law has been satisfied. In particular, the Board finds
that desirable relief may be granted without substantial detriment
to the public good and without nullifying or substantially
derogating from the intent and purpose of the Zoning By Law. The
Board further finds that a literal enforcement of the provisions
of the By Law would create a financial hardship to the petitioner.
