Dear Sirs
Upon application of the Mangano ]realty Trost to the North Andover #card of Appeals
for variances under Section 6.31, 7.1 and 7.,23 of the North'Andover Zoning By-Dawe
so as to permit the division of a lot of land into two parcels, a public hearing
was held on October 23, 1967 by the North Andover Board of Appeals. The ]nearing
was held in the Town Hall facilities after having been advertised in the Lawrenee
Eagle Tribune on the dates October 7 and 11,, 1967 and with all abutters duly notified
by certified mail. The members of the Board present and voting were: James A. Deyo,
Chairman; Arthur Drummond, Secretary; Daniel T. O'Leary, John J. Shields and Associate
Member Robert J. Burke sitting for absent member Donald J. Scott.
The applicant was represented by Atty. Salvatore J. Basile. Mr. Basile pleaded the
case by stating that there were to be no physical changes to the area as a result of
the proposed division. As the lot currently has two houses built upon it, it was
their proposal to divide the lot into two parcels amh that each could be treated as
separate entities in the future. As presently situated the applicant would be sorely
handicapped in attempting to sell either house as they mist be considered as a
package of two. He again stated that there would be no changes made to the area as
a result of the lot division.
There were no objections raised or heard.
On a motion by Member Berke, seconded by Member Shields, the petition was tabs' under
advisement. During this period the arguments were discussed and found to be sub-
stantially valid. Thus on a motion by Member Shields, seconded by Member O'Leary,
the petition was granted unanimously with one coixUtion as is noted below.
The principal reasons for granting the petition are as follows
1. Granting the petition will not deviate from the intent and purpose of the
Zoning By-laws.
2. Denial of the petition would cause hardship, financial or otherwise, to the
petitioner,

Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday
evening, .February 6, 1967 at the Town Office Building and adjourned to the Fire
Station Meeting Room due to the large number of people in attendance for the
eveningts hearings. The members present and voting were: William Chepulis, Jr.,
Chairman; Howard Gilman, Secretary; James M. Barman and George B. Farley.
SANTO MANGANO petitioned to amend the North Andover Zoning By-Law and the Zoning
Map of the Town by changing from village Residence District to General Business
District two parcels of land on Chickering Road and Bunkerhill Street, adjacent
to the petitioner's land that is already zoned for Business.
Joseph F. Bacigalupo, Esquire represented the petitioner, who was also present.
He explained that Mr. Mangano desired to extend his present land area that is
already zoned for Business to include two parcels of land, also owned by him.
One is a triangular parcel at the corner of Chickering Road and Bunker Hill
Street and contains approximately 1.,000 square feet and is adjacent to the
land that his plumbing business is presently located on. The other parcel con-
tains approxi4stely 66,000 square feet and is also adjacent to his land on which
is located his .plumbing business, bounded by Wayne Street and Bunker Hill Street.
This would be a logical extension of a business use and the land is not desirable
as a location for residential use. Mr. Mangano may build a warehouse to put
under cover various items of pipe, etc. which are now in the open because of
lack of space.
There was no opposition to the petition. Mr. Gilman made a motion to take the
petition under advisement. Mr. Farley seconded the motion and the vote was
Imnimous.
In Executive session the Board discussed and voted on the petition. Mr. Bannan
made a motion to recommend APPROVAL of the re-zoning of the two parcels of land.
Mr. Gilman seconded the motion and the vote was unanimous.

The Board gave the following reasons for approvals
1. The re-zoning of these two parcels of land would complete an area that is
already zoned for business.
2. This re-zoning would not be detrimental to the area.
.3. The re-zoning of these particular parcels would not interfere with adjacent

By unanimous vote of the Board of Appeals, an amendment is hereby mach to
a decision dated September 28, 1962 for Domenick Mangano requesting a
Special Permit for the erection of two buildings for apartments.
This amendment now permits the erection of six apartments, rather than
eight as originally requested. There will be tvo buildings, one to
contain four apartments, two stories high and the other to contain two
apartments, one story high.
This modification is in compliance with the land area requirements of
Section 4.73 of the North Andover Zoning Bylay.
The following members voted unanimously for the amendments Daniel T.
O'Leary, Chairman; Robert J. Burke, Secretary; Hovard Gilman, Villiam
Morton and Arthur Drummond., Associate Member.

Dear Sir:
The following petition was heard at a meeting of the Board of Appeals on Monday
evening, September 17, 1962 at the Town Office Building. Members present and
voting were: Daniel T. O'Leary, Chairman; Robert J. Burke, Secretary; Howard
Gilman, William Morton and Associate Member Arthur Drummond who sat in place of
regular member Henry Lund.
Domenick Mangano requested a Special Permit under Section 4.7, paragraph 4.7 to
4.73 of the Zoning By-Law so as to permit the erection of two buildings, each to
be 80 ft. long by 30 ft. deep, 2 stories high, 4 apartments on the proposed lot
of land on the premises, located at the north side and east of Bunkerhill St.
and corner of Concord Street.
This public hearing was advertised in the Nagle-Tribune on September 1 and 10,
1962. All abutters were duly notified by certified mail of this hearing. There
was one abutter present who was not opposed, but questioned the petitioners as
to water disposal.
The Board held a special meeting on Thursday evening, September 27th, to vote on
the petition, after more complete plans were presented. Mr. Morton was not present.
Mr. Burke made a motion to grant the Special Permit, Mr. Gilman seconded the motion
and the vote was unanimous.
This Speoiaslcnrnitr-Ue ranted for the following reasonst
1. There exist certain conditions, especially affecting the parcel in question,
which do not generally affect the entire zoning district in which the parcel is
located.
2. Unless the Special Permit is granted, the applicant will suffer substantial
hardship, financial or otherwise.
3. The requested Special Permit will not adversely affect the public good.
4. The requested Special Permit will not be in substantial derogation from the
intent or purpose of the Zoning By-Law.

The following petition was heard at a meeting of the Board of Appeals on Monday
evening, September 21, 1970 at the Town Office Building. The members present and
voting were: Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Donald J.
Scott, J. Philip Arsenault, Esq. and Associate Member Joseph A. Miragliotta, Esq.
Regular member Donald J. Leonard has resigned from the Board.
MANGANO REALTY TRUST requested a variation of Section 6.41 of the Zoning By-Law so
as to permit the erection of a bank on the premises, located at the east side of
Chickering Road at the intersection of Chickering Road, Pleasant Street and Bunker-
hill Street.
This public hearing was advertised in the Eagle-Tribune on September 5 and 12, 1970.
All abutters were duly notified by regular mail of this hearing.
Andrew F. Coffin spoke for the petitioners, Mangano Realty Trust, four of whom were
also present. Mr. Coffin and Mr. Santo Mangano stated that a reputable bank was interested
in establishing a bank in this location. They are asking for a variance as to the
area to allow a lot of 15,900 square feet instead of the 25,000 square feet as is
required for a lot in a general business area. The building meets all of the setback
requirements. They stated that they could erect a building on the land as it is
without having to come before the Board for a variance but the bank wants an option
to purchase the land and it would have to be divided in order to do this. There
would be approximately 30 parking spaces provided; access would be from Chickering
Road and egress would be onto Bunkerhi.11 Street.
Several abutters in the Bunkerhill and Camden Street area were opposed to the granting
of the variance because of an existing traffic problem and the hazardous conditions
there now and they also felt the area was not large enough to provide adequate park-
ing for the bank customers.

Mr. Scott made a motion to take the petition under advisement, Mr. O'Leary seconded
the motion and the vote was unanimous.
After thorough discussion of the petition, upon motion of Mr. Scott, seconded by
Mr. Miragliotta, it was voted unanimously to DENY the variance. The Board feels
there is no hardship involved since a building could be erected without requiring
a variance from the Board of Appeals and the variance they are seeking for an area
of 15,900 square feet instead of the required 25,000 square feet is too great a
deviation to be allowed from the Zoning By-Law.

The following petition was heard at a meeting of the Planning Board on
Monday evening, February 23, 1970 at 7:30 P.M. at the Town Office Building.
Members present and voting were: William Chepulis, Jr., Chairman; Robert J.
Burke, Vice Chairman; Donald N. Keirstead, Secretary; George B. Farley and
Charles W. Trombly, Jr., Esq. (who disqualified himself from sitting on this petition).
MANGANO REALTY TRUST petitioned to amend the North Andover Zoning By Law
and Zoning Map by changing from Village Residential to General Business a
triangular parcel of land on Chickering Road bounded by other land of
Mangano Realty Trust, land of Village Land Company and Town of North Andover.
Atty. Charles W. Trombly represented the petitioner and explained that the
petitioner would like to add this small piece of land to their adjacent
parcel which is already zoned business and that they have no immediate plans
for the use of the area. The parcel contains approximately 41,000 square feet.
Mrs. Elaine Griffin, represented by Atty. Robert J. White, was recorded as
opposed.

The Planning Board met again on Friday evening, February 27, 1970 with the
same members present.
Mr. Burke made a motion to recommend favorable action. Mr. Keirstead seconded
the motion. Mr. Trombly disqualified himself from voting and it was a
unanimous vote by a vote of 4-0. The following reasons are given:
1. This parcel adds to an already existing business area.
2. There would be no adverse effect on the surrounding area.
3. This would be the best land use for this parcel of land.
