TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Harry Manzi Petition: #136-90 136 Coventry Lane DECISION N. Andover, MA 01845 The Board of Appeals held a Special Meeting on Monday evening, December 17, 1990 continued from December 11, 1990 upon the application of Harry Manzi requesting a Special Permit modification from the requirements of Section 5.5, Paragraph 2 of the Zoning Bylaws so as to permit the removal of 19,000 cu. yds. off Lot 26, Coventry Lane. This would make a 25' setback now instead of the original 50' granted by petition 88-89 issued on February 13, 1990. The following members were present and voting: William Sullivan, Vice-chairman, Walter Soule, Clerk, Raymond Vivnezio and Anna O'Connor. The hearing was advertised in the Lawrence Eagle Tribune on November 26, 1990 and December 3, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit modification in accordance with the plans dated December 14, 1990 showing a 251 setback replacing original 50' set- back for rear lot line, subject to the following conditions: 1. Soil erosion controls be installed on the rear slope in accordance with the requirements of the Building Inspector and North Andover Conservation Administrator, within 30 (thirty) days. 2. Felled trees at the top of the slope are to be removed from the property within thirty (30) days. Manzi 136 Coventry Lane North Andover, MA 01845 Dear Mr. Manzi: The Board of Appeals held a regular meeting on Tuesday evening, December 11, 1990 at which time they discussed the erosion control problem at 136 Coventry Lane. Upon a motion made by Mr. Vivenzio and seconded by Mr. Sullivan, the Board voted, unanimously, that the entire bond money be seized, due to gross non- compliance with the conditions of the earth removal permit by the petitioner, unless all erosion controls required by both the Building Inspector and the Conservation Administrator are in place no later than December 22, 1990. The Board would appreciate your prompt attention to this matter. Andover, MA 01845 DECISION The Board, of Appeals held a public hearing on Tuesday evening, April 10, 1990 upon the application of Harry J. Manzi requesting a variation from the require- ments of Section 7, Paragraph 7.4 and Table 2 of the Zoning Bylaw so as to permit construction of a dwelling whose height exceeds the 35' bylaw limitation on the premises located at 136 Coventry Lane. The following members were present and voting: Frank Serio, Jr., Chairman, William Sullivan, Viec-chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio. The hearing was advertised in the Lawrence Tribune on March 28 and March 29, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board, voted, unanimously, to GRANT the variance as requested. The Board, finds that the petitioner has satisfied the provision of Section 10, Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will not derogate from the intent and purposes of the Zoning Bylaw nor will it adversely affect the neighborhood.
