ACH TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS June 27 , 1983 Mr. Daniel Long, Town Clerk Marbleridge Realty Trust Town Office Building 55 Marbleridge Road North Andover, Mass, Petition No. 31-183 Dear Mr. Long: The Board of Pppeals held a public hearing on Tuesday evening, June 14, 1983 upon the application of Marbleridge Realty Trust. The hearing was advertised in the North Andover Citizen on May 12 and 19 , 1983 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice Chairman; William J. Sullivan; Augustine W. Nickerson; and Maurice S. Foulds. The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 of the Zoning By Law so as to permit re- lief from the rear setback requirement in order to allow the con- tinued use of a cabana which does not meet the requirements of the Zoning By Law. The petitioner testified through his contractor that the structure (cabana) was constructed in June, 1982 and through an engineering error, the cabana was placed too close to the lot line. Attempts to purchase additional land to make the cabana conform have been unsuccessful and it would be very costly to move the structure. Upon a motion made by Mr.' Sullivan and seconded by Mr. Frizelle , the Board voted unanimously to grant the variance as requested. The Board finds that Section 10 . 4 of the Zoning By Law has been satis- fied. In particular, the Board finds that the location of the cabana with its slight deviation from the requirements of the Zoning By Law and the expense involved to the petitioner in moving it constitutes a hardship under the provisions of the Zoning By Law.
