Masotta Sandra Lane Petition #24-178 Mr. Daniel Long, Town Clerk Town Office Building North Andover, Ma. Dear Sir: A public hearing was held by the Board of Appeals on November 13, 1978 upon applica- tion of Cynthia J. Masotta who requested a variation of Sec. 6.3 & Tatile 2 of the Zoning By-Law so as to permit a 3.22 ft, variance on the second story of dwelling located on Lot #25, Sandra Lane and as shown on plan of land dated Auguat 11, 1978. The following,members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice-Chairman; James D. Noble, Jr.; John J. Gaffny, III; and Assoc. Member Richard J. Trepanier. The hearing was advertised in the Lawrence Eagle-Tribune on Oct. 28 & Nov. 4, 1978 and all abutters were duly notified by regular mail. Testimony was received by Mr. Frank Busa, builder, representing the petitioner, who stated that when the foundation was poured there was an oversight that the 42" dimen- sion of the balcony was not included. There was no opposition. Upon motion of Mr. Noble and second by Mr. Gaffby, the Board voted to GRANT the variance with, two provisions: 1) no stairway shall be built down from the balcony and 2) the balcony shall remain as it is with no additions or enclosures above or below it. The vote was 4-1 with Mr. Frizelle opposed.
