Maus Town Office Building East side of Richardson Ave . 120 Main Street at the corner of Pilgrim St. North Andover, Mass . Petition No. 19 183 Dear Mr. hong: The Board ,of Appeals held a public hearing on Monday evening, April 11, 1983 at 700 p.m. in the Town Office Meeting Room. The hearing was advertised in the North Andover Citizen on March 24 and 31, 1983 , and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr. ,' Chairman; Alfred E. Frizelle, Esq. , Vice Chairmanp William J. Sullivan; Augustine W. Nickerson;, and Walter F. Soule. The petitioner seeks a variance from the provisions of Section 7 , Paragraph$ 7. 1 and. 7. 2 and Table 2 of the zoning By Law to allow the subdivision of one lot into two lots having less than the rer quired area and frontage on premises located at the East side of Richardao4 Avenue at the corner of Pilgrim Street. The petitioner testified through Mr. Louis Kmiec, realtor, that a variance is required in order to allow the petitioner to construct a single family dwelling on Lot B as shown on the plan, which will not have the necessary area. There is an existing dwelling on Lot A as shown on the plan which would not have the required areaorfrontage. Further testimony revealed that a variance was granted by the Board of Appe4ls allowing the subdivision of this parcel in 1974 , being Petition No. 14 - ' 74. The Board' s decision was appealed by the abutters and was annulled by the court. Several' aloutters were present at this public hearing to voice their objectionito the present petition. Upon a motion made by Mr. Frizelle and seconded by Mr. Sullivan, the Board voted four to one to deny the variance request. Members Fri- zelle , Sulivan, Nickerson, and Soule voted in favor of the motion and MemberSerio voted im opposition. � k Paul E.
