Dear Sir:
The following petition was heard at a meeting of the Planning Board on
Monday evening, March 1, 1971 at 7:30 P.M. in the Fire Station meeting
room. Members present and voting were: William Chepulis, Jr., Chairman;
Charles W. Trombly, Jr., Vice Chairman; John J. Monteiro, Secretary;
Donald N. Keirstead and Robert J.,Burke.
VINCENT J. McALOON petitioned to amend the North Andover Zoning By-Law by
changing from Country Residential to Village Residential a parcel of land
located between Sutton Street and Chadwick Street and divided by Surrey
Drive.
Mr. McAloon explained that this proposal would increase the number of lots
by 5 and decrease the number of units from 20 to 12 since he would only
build single family homes and not duplex homes as are now built on the out-
side lots. He would do anything possible to guarantee that only single
family homes would be erected. The area is on the sewer line. Several
abutters spoke in opposition because the lots would be smaller than what
their homes are presently built on and it would overcrowd the area.
The Planning Board met again on Monday evening, March 81 1971 with the same
members present. A covenant was presented at this meeting from the petitioner
to the Town of North Andover agreeing to place restrictions on the land by a
deed to allow "single residences only, with garage". The original was
filed with the Board of Selectmen. Mr. Burke disqualified himself from voting
on this petition.
Mr. Keirstead made a motion to recommend FAVORABLE action, to consider the
proposal on its merits, without a covenant. Mr. Monteiro seconded the motion
and the vote was unanimous, 4 - 0. The following reasons are given:
1. This re-zoning would be in keeping with the surrounding area, since there
are other small lots and it properly belongs in a Village Residence zone.
It would be contiguous with the existing zoning area.

2. This would be an appropriate use of the land since it is on existing
sewer facilities.
