Dear Mr. Long:
A public hearing was held by the Board of Appeals on November 13, 1978 upon applioa-
tion of Frederick A. McCarthy who requested a variation of Sec. 6.1 and Table 2
of the Zoning By-Law so as to permit a division of land as shorn on a plan dated
Oct. 30 and revised Nov. 2, 1978 located at 65 Second St. The following members were
present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., vice
-Chairman; James D. Noble, Jr.; John J. Oaffny, III; and Assoc. Member Richard J.
Trepanier.
The hearing was advertised in the Lawrence Eagle-Tribune on Oct. 28 & Nov. 4, 1978
and all abutters were duly notified by regular mail.
The Board listened to the presentation of the petition by the petitioner for a vari-
ance 'to construct a dwelling on the parcel in question. After a review of its files,
the Board found by motion made by Mr. Trepanier, second by Mr. Frizelle and carried
by Messers. Serio, Frizelle, Trepanier and Noble voting in favor and Mr. Gaffey opposed
that the petition was the same as that acted upon by the Board on February 14, 1977
and therefore dismissed the petition pursuant to G. L. c. 40A, sec. 16.
