The Board of Appeals held a public hearing on Tuesday evening,
September 10, 1991 upon the application of Irene M. and Robert F.
McCarthy requesting a Special Permit under Section 4. 121,
Paragraph .17 of the Zoning Bylaw so as to allow a family member
an in-law apartment located at 492 Sharpners Pond Road. The
following members were present and voting: William Sullivan,
Vice-Chairman, Raymond Vivenzio, Anna O'Connor and John Pallone.
The hearing was advertised in the North Andover Citizen on July
31 and August 7, 1991 and all abutters were notified by regular
mail.
Upon motion by Mr. Vivenzio and second by Mrs. O'Connor, the
Board voted, unanimously, to GRANT the Special Permit as
requested, subject to the following conditions:
1. the premises be occupied by Irene McCarthy;
2 . the Special Permit shall expire at the time that Irene
McCarthy ceases to occupy the family suite;
3. the Special Permit shall expire at the time the
premises are conveyed to any person, partnership,
trust, corporation or other entity,
4. the applicant, by acceptance of the Certificate of
Occupancy issued pursuant to the Special Permit, grants
the Building Inspector or his lawful designee the right
to inspect the premises annually.
