MASSACHUSETTS BOARD OF APPEALS November 26, 1984 Mr. Daniel Long, Town Clerk John McLay Town Office Building 200 Middlesex Street North Andover , Mass . Petition No. 56-' 84 Dear Mr . Long: The Board of Appeals held a public hearing on Monday evening, November 19, 1984 upon the application of John McLay. The hearing was advertised in the North Andover Citizen on November 1 and 8, 1984 and all abutters were notified by regular mail . The following members were present and voting: Frank Serio, Jr. , Chairman; William J . Sullivan; Augustine W. Nickerson; and Associate Members Walter F. Soule and Maurice S. Foulds . The petitioner seeks a variance from the provisions of Section 7, Paragraphs 7. 1, 7. 21 7. 3 and Table 2 of the Zoning By Law so as to permit relief from the required lot area, frontage, and setbacks to allow the division of a lot into two lots and to allow the construction of a dwelling on premises located at 200 Middlesex Street in the R-4 zoning district. ,The petitioner testified that the parcel has been in his family for over 60 years . His mother occupies the existing dwelling at 200 Middlesex Street and his daughter wishes to construct a dwelling on the proposed lot on Norman Road, known as Lot 6. The proposed lot will consist of 4, 500 square feet with 50 feet of frontage. The proposed dwelling will require a variance from the side setback requirement of 15 feet on one side . The rear setback requirement of 30 feet will be met and the front setback of 15 feet isg reater than the average of the dwellings within 250 feet of the proposed dwelling, as allowed under the Zoning By Law. There are several similarly sized lots in the neighborhood. No opposition was voiced at the hearing. ICEtVED Wwt LONG John McLay BROWN TH L RK 200 Middlesex Street Petition No. 56- ' 84 ff November 26, 1984 ft 3 I8 39 Page 2 Upon a motion made by Mr . Foulds and seconded by Mr. Soule, the Board voted unanimously to grant the variance as requested with the following conditions: 1. That only a single family dwelling may be constructed on the new .lot . 2. That the plan be revised to show suitable off street parking. In granting the variance, the Board finds that Section 10. 4 of the Zoning By Law has been satisfied. In particular , the Board finds that a literal enforcement of the By Law would create a hardship to the petitioner and that desirable relief may be granted without nullifying or substantially derogating from the intent and purpose of the Zoning By Law. Due to the makeup of the neighborhood of smaller lot sizes , said variance will not create a detriment to the neighborhood .
