Thu following petition was board at a seating of the Planning Board an Monday
evening, February 17, 1964 at the Towa Office Building. Members present and
voting wares James M. Bannon, Chairman; Robert J. Burke, Secretary; Howard
Gilman, George Farley and William, Chepalis,
JOHN J. McLLY petitioned to amend the North Andover Zoning By-law by changing
from Rural Residential to General Business, a parcel of land an Turnpike Street
near Willow Street, across from land of George Rea, containing approximately
6.7 acres.
Jobn MoLay explained that be wants to bave a Nursery, consisting of trees,
shrubs, etc. on that parcel. There were appar= six people present, bat there
was no opposition to the petition.
Mr. Gilman made a motion to approve the re-zoning. Mr. Burke seconded the actin.
Members Burke, Gilman, Farley and Cbspulis voted in favor. Chairman Hannan voted
No because he did not believe the present Business Zoning Law is sufficiently
restrictive.
Reasons for approval ares
1. ThAsepareel of land is on a heavily travelled bighway that does not lead
itself to residential. development.
2. Thera is a great awed for business locations in town.
3. ' The re-zoning of this area is for the general good of the town.

The following petition was heard at a meeting of the Planning Board on ay
evening April 27, 1970 and continued on May 4, 1970 at the Town Office Building.
The following members were present and voting: William Chepulis, Jr., Chairman;
John J. Monteirof Secretary; Charles W. Trombly, Jr., Vice Chairman; Robert J.
Burke and Donald N. Keirstead.
JOHN J. McLAY petitioned to subdivide a parcel of land containing five lots and
approximately seven acres on Turnpike Street (Route 114) at the location of his
Garden Center. It is proposed that •he will sell Lot #4 to R.C.A. Consumer Products
Division and that they wish to construct a building there. Mr. McLay appeared on
his own behalf and a representative from R.C.A. was also present. Preliminary plans
had been presented to the Board previously and several recommendations and changes
were made on the Definitive plans, as requested. There were no abutters present
and there was no opposition to the petition. Mr. Keirstead made a motion to take
the petition under advisement, Mr. Trombly seconded the motion and the vote was
unanimous.
A meeting was held on Tuesday evening, May 12, 1970 at which time the same members
were present with the exception of Mr. Trombly who was unable to attend. Letters
were received from the Board of Public Works, Highway Department and Board of Health.
The Board discussedand voted on the petition. Mr. Keirstead made a motion to
APPROVE the subdivision subject to certain conditions as listed below. Mr. Monteiro
seconded the motion and the vote was unanimous.
The conditions are as follows:
1. That the record owners of the subject land execute and record a "covenant
running with the land" within 20 days from the date of this decision, or otherwise
provide security for the construction of ways and the installation of municipal
services within said subdivision, all as provided by G.L. c. 41, s. 81—U.
2. That all such construction and installations shall in all respects conform
to the governing rules and regulations of this Board.

3. Thatj as required by the North Andover Board of Health, no building or other
structure shall be built or placed upon lots as shown on said plan without the
prior consent of said Board of Health.
4. That 'water and sewer will be according to the rules and regulations of the
Board of Public Works.
5. That surface drains and street bounds must be installed. The roadway shall be
hot-topped and consist of 2" binder and 1" wearing surface and further construction
shall be ',in accordance with other requirements under the Subdivision Rules and
Regulations of the Planning Board. Proper street signs must be installed.
6. Must comply with the Board of Fire Engineers' requirements as to the fire alarm
system.

Requirements as to the contents of "definitive plans":
G.L. c. 41, s. 81 0, briefly describes a "definitive subdivision plan" as "a
plan of such proposed subdivision, showing the lots into which such land is to
be divided and the ways already existing or which are to be provided..... for
furnishing access to such lots....." However, such a plan should also supply
the data required of "preliminary plans" under G.L. c. 41, s. 81 L, as follows:
"Preliminary plan" shall mean a plan'of a proposed subdivision or resubdivi-
sion of land drawn on tracing paper, or a print thereof, showing (a) the
subdivision name, boundaries, north point, date, scale, legend and title
"Preliminary Plan"; (b) the names of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the names of all abutters, as
determined from the most recent local tax list; (d) the existing and proposed
lines of streets, ways, easements and any public areas within the subdivision
in a general manner; (e) the proposed system of drainage, including adjacent
existing natural waterways, in a general manner; (f) the approximate boundary
lines of proposed lots, with approximate areas and dimensions; (g) the names,
approximate location and widths of adjacent streets; (h) and the topography of
the land in a general manner.
It should also conform to the rules and regulations of the North Andover
Planning Board relative to definitive plans, and to the requirements imposed
by law for the recording of plans at the Registry of Deeds.

Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening,
November 19, 1984 upon the application of John McLay. The hearing
was advertised in the North Andover Citizen on November 1 and 8,
1984 and all abutters were notified by regular mail . The
following members were present and voting: Frank Serio, Jr. ,
Chairman; William J . Sullivan; Augustine W. Nickerson; and
Associate Members Walter F. Soule and Maurice S. Foulds .
The petitioner seeks a variance from the provisions of Section 7,
Paragraphs 7. 1, 7. 21 7. 3 and Table 2 of the Zoning By Law so as to
permit relief from the required lot area, frontage, and setbacks
to allow the division of a lot into two lots and to allow the
construction of a dwelling on premises located at 200 Middlesex
Street in the R-4 zoning district.
,The petitioner testified that the parcel has been in his family
for over 60 years . His mother occupies the existing dwelling at
200 Middlesex Street and his daughter wishes to construct a
dwelling on the proposed lot on Norman Road, known as Lot 6. The
proposed lot will consist of 4, 500 square feet with 50 feet of
frontage. The proposed dwelling will require a variance from the
side setback requirement of 15 feet on one side . The rear setback
requirement of 30 feet will be met and the front setback of 15
feet isg reater than the average of the dwellings within 250 feet
of the proposed dwelling, as allowed under the Zoning By Law.
There are several similarly sized lots in the neighborhood.
No opposition was voiced at the hearing.

Upon a motion made by Mr . Foulds and seconded by Mr. Soule, the
Board voted unanimously to grant the variance as requested with
the following conditions:
1. That only a single family dwelling may be constructed on the
new .lot .
2. That the plan be revised to show suitable off street parking.
In granting the variance, the Board finds that Section 10. 4 of the
Zoning By Law has been satisfied. In particular , the Board finds
that a literal enforcement of the By Law would create a hardship
to the petitioner and that desirable relief may be granted without
nullifying or substantially derogating from the intent and purpose
of the Zoning By Law. Due to the makeup of the neighborhood of
smaller lot sizes , said variance will not create a detriment to
the neighborhood .
