MASSACHUSETTS BOARD OF APPEALS October 16 , 1986 William & Cora McMillan 28 Rock Road North Andover, MA 01845 Petition #25-87 Mr . 'Daniel Long, Town Clerk Town Office Building North Andover , MA 01845 Dear Mr . Long: The Board of Appeals held a public hearing on Tuesday evening , October 14 , 1986 upon the application of William & Cora McMillan . The hearing was advertised in the North Andover Citizen on September 18 and September 251 1986 and all abutters were notified by regular mail . The following members were present and voting: Alfred Frizelle , Vice-chairman , Augustine Nickerson , Clerk , William Sullivan, Walter Soule and Raymond Vivenzio . The petitioner seeks a variance from the requirements of Section 7 , Paragraph 7 . 3 and Table 2 of the Zoning ByLaws so as to permit a wooden open deck to remain too close to the rear lot line , 27 feet , more or less , located on the premises at 28 Rock Road. Upon, a motion made by Mr. Sullivan and seconded by Mr. Nickerson , the Board voted to GRANT the variance of Section 7 , Paragragh 7 .3 and Table 2 of the Zoning ByLaws in order to let the wooden open deck remain as is . The vote was unanimous to GRANT this variance , as requested. The Board finds that it would create a hardship to the petitioner if this variance were denied, as the deck was in place prior to the purchase of the ,property and, in no way deters from the neighborhood.
