Dear Sir:
This office is in receipt of a copy of a document entitled
"Notice of Appeal" submitted by the Meadowview Condominium
Association. This appeal should not be processed for the
following reasons:
1. The "appeal" is not filed with the Board of Appeals
as required by law.
2 . The "appeal" is not timely filed.
3 . A Condominium Association is not a "person aggrieved"
(G. L. Chapter 40 Section 13) and therefore is not
entitled to bring an appeal.

NOTICE OF APPEAL
The undersigned hereby appeals the granting of a building permit for the
property located on Walker Road, adjacent to the site of the Meadow View
Condominiums in North Andover, Massachusetts pursuant to Section 10.4 of the
Zoning By-laws of the Town of North Andover, Massachusetts.
As grounds therefor, the undersigned states that the site plan filed with the
application for a building permit and approved therewith, requires Walker Road,
located in a R-5 district, to be used to provide access to a parcel of land zoned
General Business, and which parcel will in fact be used as the site of a commercial
office park, in violation of the Zoning By-laws of the Town of North Andover. The
permissible uses for an R-5 district do not include the use of property zoned R-5 to
provide access to a parcel developed for commercial use or zoned for General
Business.
