Conditions for Approval of Special Permit:
1. The front entrance shall be in the presently existing
breezeway.
2. There shall be no other entrance to the family suite in
the front of the building.
3. Prior to the issuance of a building permit, the Special
Permit shall be recorded at the Registry of Deeds by the
Board of Appeals .
4. The family somite is solely for occupancy by Irene Meikle ,
mother of Robert Meikle.
5 . The Special Permit shall expire at the time Irene Meikle
ceases to occupy the family suite.
6. The Special Permit shall expire at the time the premises are
conveyed to any person, partnership, trust or corporation.
7. The applicant, by acceptance of the Certificate of Occupancy
issued pursuant to the Special Permit, grants the Building
Inspector or his lawful designee the right to inspect the
premises.

Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
March 11, 1985 upon the ,petition of Robert Meikle . The hearing
was advertised in the North Andover Citizen on February 21 and
28, 1985 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr. ,
Chairman; Alfred E. Frizelle, Esq: , Vice Chairman; William J.
Sullivan; and Walter F. Soule.
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7. 3 and Table 2 of the Zoning By Law to permit relief
from the side setback requirement to allow the construction of a
garage and a Special Permit under Section 4, Paragraph 4 . 121 (17)
of the Zoning By Law to allow an in-law apartment, or "family
suite" on premises located at 871 Salem Street.
Testimony revealed that the in-law- apartment, consisting of a bed-
room, living room, kitchen and bath, is needed for Mr. Meikle 's
mother. The apartment will be located in the existing garage and
the variance is needed to construct a new garage on the parcel.
Following opposition from two abutters, the variance request was
withdrawn by the applicant.
The Board, upon a motion made by Mr. Frizelle and seconded by Mr.
Sullivan, voted unanimously to take the petition under advisement
and rendered a decision at a regular meeting held on Monday evening,
April 8, 1985 , with Members Serio, Frizelle, Sullivan and Soule
again present and voting.

Upon a motion made by Mr. Frizelle and seconded by Mr. Soule , the
Board voted unanimously to grant the Special Permit for the in-
law apartment for the existing dwelling and garage only with no
additions under the provisions of the Special Permit subject to
the following conditions
1. The front entrance shall be in the presently existing breeze-
way.
2. There shall be no other entrance to the family suite in the
front of the building.
3. Prior to the issuance of a building permit, the Special Permit
shall be recorded at the Registry of Deeds by the Board of
Appeals.
4. The family suite is solely for occupancy by Irene Meikle ,
mother of Robert Meikle .
5 . The Special Permit shall expire at the time Irene Meikle ceases
to occupy the family suite.
6 . The Special Permit shall expire at the time the premises are
conveyed to any person, partnership, trust or corporation.
7. The applicant, by acceptance of the Certificate of occupancy
issued pursuant to the Special Permit, grants to the Building
Inspector or his lawful designee the right to inspect the
premises .
In granting the Special Permit, the Board finds that all the con-
ditions set forth in Section 10 . 31 of the Zoning By Law have been
satisfied. Specifically, the Board finds:
1. That the specific site, 871 Salem Street, is an appropriate
location for an in-law apartment since the proposed apartment
will be located in an existing garage with no substantial
exterior change to the existing dwelling.
2 . That the use as developed will not adversely affect the neigh-
borhood, since the use when completed will not change the
single family appearance of the premises .
3. There will be no nuisance or serious hazard to vehicles or
pedestrians since there will be only one occupant of the ..in-
law apartment.

4. Adequate and appropriate facilities will be provided for the
proper operation of the in law apartment.
5. The use will be in harmony° with the general purpose and
intent of the Zoning By Law.
