Andover, MA 01845 ** * * The Board of Appeals held a public hearing on Tuesday evening, January 8, 1991, continued from the October, November and December meetings, upon the application of Merrimack Valley Gymnastics requesting a Special Permit from the requirements of Section 4.131, Paragraph 9 and Section 4.11.1 and as a Party Aggreived from the Zoning Bylaw so as to permit operation of a gymnastic facility in an I-1 zoning district on the premises located at 85 Flagship Drive. The following members were present and voting: Frank Serio, Jr. , Chairman, Walter Soule, Clerk, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on September 26, 1990 and October 3, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Soule and seconded by Mr. Rissin, the Board voted, unanimously, to DENY the Special Permit and Party Aggreived as requested. The Board finds that this is not a proper location for a children`s gymnastic school because of the many industries using chemicals in this area. Dated this 10th day of January, 1991. MASSACHUSETTS BOARD OF APPEALS * Richard Rosten * Petition: 1137-90 1705 Turnpike St. N. Andover, MA 01845 DECISION * The Board of Appeals held a public hearing on Tuesday evening, January 8, 1991 upon the application of Richard Rosten requesting a Special Permit from the requirements of Section 6, Paragraph 3(f) of the Zoning Bylaw so as to permit having a proper "convenience store" identification sign on the premises located at 1705 Turnpike Street. The following members were present and voting: Frank Serio, Jr. , Chairman, Walter Soule, Clerk, Raymond Vivenzio, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on December 19, 1990 and December 26, 1990 and all abutters were notified by regular mail. Upon a motion made by Ms. O''Connor and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit, allowing the petitioner to change one (1) of the primary signs to a secondary sign and add "mini Mart" to the Sunoco sign. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning Bylaw and that the granting of this Special Permit will not derogate from the intent and purpose of the Zoning Bylaw nor will it adversely affect the neighborhood.
