Dear We Lyons: A public hearing was held by the Board of Appeals on August 11, 1975 upon application of the Merrimack Valley National Bank who requested a variation of Section 6.3 of the Zoning By-Law so as to permit an addition to the banking office facilities as shown on a plan and located at 154 Main Ste The following members were present and voting: Frank Serio, Jr., Chairman; Alfred Frizelle, Vice-Chairman; William N. Salemme, Clerk; Louis DiFruscio and James D. Noble, Jr. The hearing was advertised in the Lawrence Eagle-Tribune on July 26 and August 2, 1975 and all abutters were duly notified by regular mail. The petitioner seeks a variance from the 2p.-Law Section 6.3, front setback requirements, to enable it to construct an addition to its present building on Main Street. In support of its position, the petitioner pointed out that the character of the land prohibits it from placing the additions to the rear of the existing building since there is a drop-off which would require large amounts of$11. At present, there is a driveway extending around the building and, if the addition were to be constructed in the rear, access to the drive-in teller window would be denied. The proposed addition would not differ from the existing design of the brisk. After a review of the petition and upon motion of Mr. Frizelle and second by Mr. DiFruscio the Board voted unanimously to GRANT the above variance. The Board in making its decision has determined that each element of Section 9.5 have been met. To require the petitioner to fill the drop-off to construct the addition would impose an unrealistic financial i Page -2- Merrimack Valley Nat'l Bank hardship upon the petitioner. The proposed construction does not derogate from the intent and purpose of the By-Law since the location is in the do: atown business district of North Andover where there is little, if any, front setback.
