Plan", so-called, lot 2 adjoining the Berthel lot on
the north (and fronting on. Osgood Street) and lots 3, 4
and 5 fronting on Phillips Brooks Road, hereby acquiesce
in said petition, in so far as we may legally do so, and

PETITIONER'S REQUESTS FOR MMINQS
The petitioner above named now requests this Honorable Board to
make the following rulings as to its jurisdiction over the subject matter
of her petition:
1. That the Board of Appeals has the power to grant her petition by
virtue of section 1(a) of Article VI of the Zoning By-law of North Andover.
2, That the Board of Appeals has the power to grant her petition by
virtue of section 30 of chapter 40 of the General haws of the Commonwealth
(especially paragraph numbered 3 therein).
3. That the provisions of section 2(b) of Article IV of the Zoning
By-law of North Andover may be varied,i.n a proper case, by the Board of
Appeals, so as to permit the construction of a building withi# twenty feet
of a street line.
4. That the provisions of section 3 of Article IV of the Zoning By-law
of North Andover may be varied, in a proper case, by the Board of Appeals,
so as to permit a side yard of less than ten feet in width.
5. That the provisions of section 3 of Article IV of the Uning
By-law of North Andover may be varied by the Board of Appeals, sous to
permit a side yard of less than ten feet in width, where the record owner
of the adjoining property has indicated his assent to the granting of such
variance.
