The allegation that the stabling of the horse at 94 Boxford Street, North Andover, is a distance of 20 to 30 feet from the well was not borne out by my investigation and find that the well is 50 foot distant from the stable. 2. The gradient of land around the stable is such that infiltration of the well casing is not probable. 3. The condition of the stable and the corral area at the time of my investigation would make it seem unlikely that offensive odors would be transmitted substantially beyond said area. There has been no permit issued from theBoardof Health for the stabling of a horse on said premises. Should the zoning issue be resolved by Mr. Charles Foster, Building Inspector, with regard to the three (3 ) acre requirement, I find that it would be appropriate for the Board of Health to issue a permit. Berthold, who stables and maintains a pony on a lot of land, 1.2 acres in area, owned by him. Your letter indicates that you ordered him, some time ago, to discontinue this use of his lot because of the- provisions of the Zoning By-haw, but that since that time he has obtained a lease of an adjoining parcel from another landowner, so that he presently has the use of an area in excess of three acres. The property in question is in the R-2 Zoning District, and the governing provision of the Zoning By=-Law is s.4. 121 (6) (b) . This section of the By-Law provides that a permitted use in the R-2 District is "on any lot of at least three. . . .acres, the keeping of a total of not more than three. . . .of any kind of assortment of animals. . . ." . This provision, however, should also be read in the light of s. 2.43 of the Zoning By-Law which defines "lot" as "an area of land in one ownership with definite boundaries" . It is fundamental, of course, that the lessee of real es- tate does not acquire ownership of land except in cases involving a lease for a great period of time. Accordingly, upon the basis of the facts given to me by your letter, it is my considered opinion that Mr. Berthold does not "own" more than 1 .2 acres of land, and that he is, therefore, in violation of the provisions of the Zoning By-Law quoted above. If you have any further questions concerning this matter please let me have them. Dear Sir: A public hearing was held by the Board of Appeals on Monday evening, December 8, 1975 upon application of John L. Berthold who requested an appeal under the requirements of Sec. 9.22 of the Zoning By-Lax so as to permit tta; stabling of a pony on the premises located at 94 Boxford St. The following members were present and voting: Frank Serio, Jr. , Chairman; William N. Salemme, Clerk; James D. Noble; Jr.; Louis DiFruscio; and Alternate Member, Walter Jamitkowski. I The hearing was advertised in the Lawrence Eagle-Tribune on Nov. 22 & 29, 9975 i and all abutters were duly notified by regular mail. The petitioner appealed an order of the Building Inspector stating that a pony j could not be kept on the premises at 94 Boxford St. During a discussion of the petition, Messers Anthony Campagna and Virgilio Gigliotti, both abutters, voiced opposition. The Board, in reviewing the facts presented to it, deems that the petitioner failed to satisfy each and every provision of Section 9.5 of the By-Law and upon motion of E Mr. DiFruscio and second by Mr. Noble to DENY the petition the vote was unanimous. The Zoning By-Law requires three acres of land as a minimum requirement to have animals. Berthold, who stables and maintains a pony on a lot of land, 1.2 acres in area, owned by him. Your letter indicates that you ordered him, some time ago, to discontinue this use of his lot because of the provisions of the Zoning By-Law, but that since that time 'he has obtained a lease of an adjoining parcel from another landowner, so that he presently has the use of an area in excess of' three acres. The property in question is in the R-2 Zoning District, and the governing provision of the Zoning By-Law is s.4. 121 (6) (b) . This section of the By-Law provides that a permitted use in the R-2 District is "on any lot of at least three. . . .acres, the keeping of a total of not more than three. . . .of any kind of assortment of animals. . . ,i1 . This provision, however, should also be read in the light of s. 2.43 of the Zoning By-Law which defines "lot" as "an area of land in one ownership with definite boundaries". It is fundamental, of course, that the lessee of real es- tate does not acquire ownership of land except in cases involving a lease for a great period of time. Accordingly, upon the basis of the facts given to me by your letter, it is my considered opinion that Mr. Berthold does not 'town" more than 1 .2 acres of land, and that he is, therefore, in violation of the provisions of the Zoning By-Law quoted above.
