Dear Sir:
The North Andover Board of Appeals comprising Arthur R. Drummond, Chairman;
Daniel T. O'Leary, Secretary; J. Philip Arsenault, Esq., Donald J. Scott and
Donald J. Leonard met in regular monthly session on Monday, August 10, 1970
in the Town Office Building to hold a hearing upon the application of Mrs.
J. Edmond Elliot who requested a variance as advertised in the Eagle-Tribune on
July 25 and August 1, 1970. All abutters were duly notified by regular mail.
Mrs. Elliot wishes to build a small house between Berkeley and Bevin Roads at the
corner of Turnpike Street with 32 feet front, 24 feet deep and one story high to
be used as a residence in a country residential zone. Her request for a variance
is based on Section 7.22 of the Zoning ordinance because the dwelling would be
nearer the lot line than is allowed.
Mrs. Elliot was unable to be present and was represented by her son Robert, who
stated that the majority of the lot is very wet and impractical to build upon
and the only possible location, although there is plenty of land, would require a
variance of the lot line setbacks. Other homes in the area are near the lot lines
and built upon small lots and the house in the proposed location would not be
detrimental to the appearance of the neighborhood. Charles Foster, speaking as a
private citizen, substantiated these statements. The lot of land consists of
25004 square feet. Robert Leland spoke in favor of the request. Henry Fink was
opposed.
After taking the matter under advisement, the Board unanimously voted to GRANT the
variance upon motion of Daniel T. O'Leary, seconded by Donald J. Leonard subject
to corrected plans being submitted showing the area as one lot and the total area
and that no other dwellings can be erected on the lot and the site must be main-
tained
aimtained as one lot. The reasons for granting the variance are that the general
character of the neighborhood will not be materially affected and the applicant
would suffer hardship, financial or otherwise.
