The undersigned wishes to record the accompanying plan and requests a determina—
tion by said Board that approval by it under the Subdivision Control Law is not
required. The undersigned believes that such approval is not required for the
following reasons:
1. The division of land shown on the accompanying plan is not a subdivision
because every lot shown thereon has the amount of frontage required by the
North Andover Zoning By—Law and is on

appropriate endorsement has been made upon the same.
2. The North Andover Planning Board has determined that said plan shows
a subdivision, as defined by G.L. c. 41g s. 81-L9 and must therefore
be re-submitted to it for approval under the subdivision control law.

Dear Sir:
A public hearing was held by the Board of Appeals on March 12, 1973 upon applica-
tion of ARMAND E. LaPOINTE who requested a variation of Section 6.1 of the Zoning
By-Law so as to permit the erection of a dwelling on a 100x100 sq. ft. lot; lo-
cated at the westerly side of Autran Avenue, approx. 500 feet from Massachusetts
Avenue. The following members were present and voting: J. Philip Arsenault, Esq.,
Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond, Frank Serio, Jr. and
William N. Salemme.
The hearing was advertised in the Lawrence Eagle-Tribune on February Zia. and March 31
1973 and all abutters were duly notified by regular mail.
Mr. LaPointe appeared on his own behalf and explained that a house is presently
existing on one lot and that his daughter and son-in-law would like to build a
home on the other lot. Water and sewer facilities are available. One lot fronts
on Autran Avenue and one fronts on Adams Avenue. There were no abutters present
and there was no opposition.
Mr. Serio made a motion to GRANT the variance with the condition that only a single
family house may be built and that proper plans be submitted; Dr. Beliveau seconded
the motion and the vote was unanimous. The Board found that there would be a
hardship, financial or otherwise, if the petitioner were not able to use the vacant
lot for a dwelling for his daughter. That there are many lots in the area of similar
size or smaller and that it would not adversely affect the neighborhood or derogate
from the intent of the By-Law.
