Dear Mr . Long:
The North Andover Planning Board held a public hearing on
Monday evening, December 2, 1985 in the Town Office Meeting Room
upon the application of Elm Square Builders of Andover, MA The
hearing was advertised in the North Andover Citizen on November 14
and 21, 1985 . The following members were present at the December
2, 1985 meeting: Michael P. Roberts, Chairman; Paul A. Hedstrom,
Vice Chairman; John A. James, Jr. , Clerk; John J. Burke and Erich
W. Nitzsche.
The petitioner seeks a Special Permit under Section 8,
paragraph 3; Site Plan Review. The purpose of the Site Plan
Special Permit is to review Elm Square Builder ' s proposal to
construct a new office building with associated parking. The
premises is .located on the east side of Salem Turnpike and known as
Route 114 possessing 6.55 acres in an I-1 Zoning District . At the
hearing, Clifford Carlson represented Elm Square Builders and Mr.
Joe D'Angelo from the Mass. DPW was in attendance.
Comments from Clifford Carlson:
- The site consists of 6 . 5 acres, the proposed building is 11%
of the lot .
- There will be 94 parking spaces.
- The building will not be seen from Route 114 because of
trees.
- There are no definite tenants therefore no projected
employee numbers.

Comments from Joe D'Angelo:
- Many issues regarding Route 114 have to be looked at with
respect to special permits submittal, e.g. , decelleration
lanes, widening of roads, etc.
The Planning Board requests the applicant to submit the
following:
1. Recommendation from the Mass . DPW accompanied by Permits.
2. Have MEPA review the project and make recommendations.
3. File an Order of Conditions with the North Andover
Conservation Commission.
The following members were present and voting at the February
3, 1986 meeting when the board rendered their decision.
Michael P. Roberts, Chairman; Paul A. Hedstrom,
Vice-Chairman; John A. James, Jr. , Clerk, John J. Burke,
Erich W. Nitzsche.
Upon a motion made by John A. James, Jr. and seconded by John
J. Burke, the board voted to grant the petition for Site Plan
Approval under Special Permit process for Elm Square Builders Plan
dated October, 1985 by Diprete, Marchionda and Associates, Inc.
Engineering and Planning Consultants, 185 New Boston Street,
Woburn, MA 01801 subject to the following:
1. Construction of the project shall be in complete uniformity
with:
a. Definitive Site Plan for Route 114 offices for Elm
Square Builders (site work construction Sequence, 2
pages) October 1985 .
b. Landscape Plan. Route 114 Office, dated November 1985 .
C. Grading and Erosion Control Plan for Elm Square
Builders, dated May 1985 .
d. Dept. of Public Works Curb cut Permit No. 5-17909 dated
January 13, 1986.
2. Any modification to the approved plans shall require review
of the Planning Board to the necessity of a reapplication
under Section 8, para. 3 of the Zoning Bylaw.
3. The applicant must contact the Corps of Engineers and
obtain a 404 permit before any fill can be placed in the
wetlands.
4. The applicant shall be aware of the outstanding
responsibility to the N.A.C.C. Order of Conditions dated
June 12, 1985.
5. The building must be fully sprinkled under MGL Chapter 148
Section 26G.
In granting this Special Permit, the Planning Board finds
pursuant to Section 10.31 - Conditions for Approval of Special
Permits of the Zoning Bylaw, that the following conditions are met:
- There will be no nuisance or serious hazard to vehicles or
pedestrian due to the following:
a. The site is a designated I-1 zoning district located
along the Route 114 Corridor, with approved curb cut and
MEPA endorsement.
- Adequate and appropriate facilities will be provided for the
proper operation of the proposed office complex totalling
39,000 square feet .
- The proposed use is less intrusive and intensive than
otherwise permitted in Section 4. 129 Industrial I District
of the Zoning Bylaw.
- Based on site visits, the hearing process, and review and
input by Town Boards, and departments, the proposed use
which is permitted in Section 4. 129 is considered in harmony
with the general purpose and intent of the Bylaw.
