Dear nIr. Long: A public hearing was held by the Board of Appeals on June 11, 1979 upon application of Sidney Chadwick who requested a variation of Sec. 7.1 & Table 2 of the Zoning By—La,u so as to permit a variance from minimum lot area requirement on the premises located at 324 :'linter St. and shown on a plan of land dated Kay 11 , 1979 (prepared for Francis Trembly). The following members were present and voting: Alfred E. Frizelle, Esq. , Vice—Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr.; Richard J. Trepanier, Esq.; and Assoc. "ember, William J. Sullivan. The hearing was advertised in the North Andover Citizen on ?"ay 24 & 31 , 1979 and all abutters were duly notified by regular mail. The particular lot. in question was surveyed and recorded as containing the necessary lot area on a plan dated 12/17/63, recorded on 6/12/70. The petitioner introduced evidence to the Board showing that upon subsequent examination the original plan did not have the necessary lot area. A dwelling was constructed on the premises and con— forms to the By—Law in every gray except area. The error appears to have been made by the original surveyor. Upon motion made by I•"r. Trepanier, seconded by Kr. DiFruscio it was voted unanimously to MAJTT the variance. The Board, in granting the variance, finds that the granting will not derogate from the intent and purpose of the By—Law and, further, that failure to do so would be a substantial hardship to the petitioner.
