HomeMy WebLinkAbout1959-04-13Monday, April 13, 1959 RegularMeeting 201- The regular monthly meeting of the Board of Appeals was held on Monday, April 13, 1959 atT:30 PM at the To~nBn~lding. Members present and voting were: Daniel T. O'Lear~y, Chairman, Charles Foster~ Jr., Howard Gilman~ WilllamMorton and Alfred Boeglin. Mr. O,LearydesignatedMr. Morton, Associate Menber to sit in place of ~. Lurid, regular member who was absent and h~. Boeglin, Associate Me~ber to sit in place of Mr. Burke regular member who was also absent. The hearing of Edward H. Keeler's application was continued £romMarch 9. Atty. Alfred Daniel represented the petitioner. Atty. Daniels presented new plans and showed a picture of the t~ype building proposed to be erected. It was pointed out the State has control of placing entrances and exits on the highway. }ir. William Chepulis, an abbutter, abjected to the petition. He pointed out this was mn industrial area and felt theTo%~n should keep the land open for industries coming into the area. He stated this type restaurant caters to teenagers mostly and it is a bad place for youngsters to congregate. Atty. Daniels pointed out a restaurant is allowed in an Industrial area. It was also pointed out the land in ~iuest~on is a sall odd shaped lot that would be hard for industry to use. The buJ lding to be erec'~ed would cost in the vicinity of ~1,000. Mr. Chepulis stated the land value would depreciate if this type of business were allowed. M~s. Chepulis sooke about the traffic problem in the area stating the children have to walk on-the highway sometimes when the school bus does not let them off in front of the house. ~ Mr. Gilman brought out the fact this should be taken up with the School Co~mmittee to make sure the cbdldren are left off in front of the house. Mr. Rs!oh Brasseur, CE. stated he felt the Chepulis Family are non-conformlng to the By Law rather than ~. Heeler's petition as they are in an Industria area. He pointed out the valueof the land for residential use if much lower then land for industrial use in this area. He also stated if the house were burned more than 60% it cot.ld not be rebuilt in the area. I~. O'Leary asked how much footage was in the Chept~s lot and was told 29,600 square feet. Mr. Foster asked what Industrial area land is walued at and Atty. Daniels said ~pproximate!y 30~er square foot. Mr. Gflman stated he felt %t is now about 355. Mr. Gilman moved to take the ~atter under advisement. Mr. Morton seconded the motion. Unanimous vote. Atty. Anthony Randazzo once more apoeared before the Board for Carmelo Marino asking what could be done now that their petition had been denied. He went over 2O2 the entire case but the Board said as far as they knew nothing more coLtld be done for Mr. ~rino. The matter of Edward Keeler's application was discussed and it was decided the Board would ask for more detailed plans showing the type of b~lding to be erected, contour of land, et. April 27 was set for the date of the hearing for Rose Filetti and Bonnellt and Corradino. Mr. Gilman moved the meeting adjourn at 10:15 PM. Mr. Norton seconded the motion. Unanimous vote. Clerk
